Najib & Zambry supported by MCA & Gerakan guilty of making a cartoon (a joke) of the State of Perak. The people of Perak suffer in consequence. Inabilility to restore the telephone lines to the State Secretariate & the Director of land and mines buildings after 3 weeks is the latest joke Zambry create out of Perak.

Fresh from the ‘success’ of spinning the ‘Black Metallic Zambry’remark, BN appointed Perak Menteri Besar Dato’ Seri Zambry bin Abdul Kadir in trying to split YB Nga Kor Ming’s one remark into 2 to try to score further political points. The remark made the YB Nga Kor Ming was ‘Hitam Metalik Zambry Menteri Besar Perak Darul Kartun’

‘Black Metallic Zambry’ was a humour adapted from the Black Metallic Camry which the BN opposed when the Perak PR government bought Black Metallic Toyota Camry cars to replace the ailing Proton Perdanas. The phrase was used because it rhymes.The skin colour of a person is never described as metallic. Zambry knew that Kor Ming was referring to the colour of the Camry car but played racial politics by twisting it to say it refers to the human skin colour. He makes a cartoon of himself when he twisted the remark to refer to darker skin people.This in the level BN appointed power crazy Menteri Besar will stoop.

Now Zambry in trying to spin and say that YB Nga Kor Ming is disrespectful of the State when he described the State as ‘Perak Darul Kartun’

Najib & Zambry supported by MCA & Gerakan are guilty of making the Perak State a cartoon (a joke) and yet Zambry is accusing others of being disrespectful of the State.

I am astonished that Zambry still did not realize that he has made the Perak State a joke due to his actions. Unfortunately, the people of Perak became victims and suffered in misery.

The following incidences have made the Perak State a joke to many people : -

(i) Democratically elected government ousted by non democratic means
(ii) Refusal of BN to respect the wishes of the people by calling a fresh election.
(iii) Not allowing the State Assembly Speaker (undisputed at that point of time) to
convence a sitting at the State Assembly Hall and he was forced to conduct the
sitting under a tree.
(iv) The State Assembly Speaker was forcibly removed from his seat in the State Assembly
and imprisoned in a room.
(v) State Budget passed within 20 minutes without debate.
(vi) Microphones of opposition elected representatives switched off so that their
speeches will not he heard and also not recorded in the Hansard.
(vii) Using the Police to invade and control the State Assembly.
(viii) Elected representatives not allowed to enter the State Assembly without permission
of the police & civil servants stationed at the locked doors of the Assembly.
(ix) Elected representatives allowed into Assembly only if issued with a pass by the
State Secretary. Even former BN Menteri Besar, Tan Sri Dato Seri Di Raja Tajol
Rosli was offended and described it as demeaning.
(x) Judges do not follow the law (precedents) when deciding on Perak crisis cases.
(xi) Laws are selectively applied (especially Article 72 of the Federal Constitution
prohibiting interference of the Judiciary in matters of the State Assembly)
(xii) A court Registar can appoint a Court of Appeal Judge to sit and stay (suspend) the
decision of the High Court judge who has declared Dato’ Sri Nizar Jamaluddin as the legitimate Menteri Besar when there were 2 other panel of 3 judges each of the Court of Appeal sitting on that day. The stay was granted within 24 hours!
(xiii) The swearing in of Zambly as Menteri Besar was obstructed and spontaneously objected to by thousand of protestors.
(xiv) BN Government refused to answer questions asked in the State Assembly without valid reason.

Zambry should stop making a clown of himself and continue to make the Perak State a cartoon by continuing to spin falsehood.
Many investors have expressed their unwillingness to invest in the State of Perak until the illeginate government of Zambry is replaced. The Perakeans are unfortunately the victims who continue to suffer in consequent of Zambry continuing to make a cartoon of the Perak State.
The latest joke Zambry created out of Perak is that the telephone lines to the State Secretariate and the Director of land and mines buildings (both buildings form the seat of administration of the Government of Perak) have yet to be restored despite having been down for the last 3 weeks.

Let the people of Perak be reminded of these black days of Perak after the grab of power by BN since February 2009 and be united to oust the undemocratically installed BN government in the coming General Election.

Irregularities in the award of contracts by Rural Development Ministry costing the people at least RM500,000,000.00‏

Media Statement by YB Ngeh Koo Ham, Member of Parliament for Beruas in Parliament on the 10th Nov 2011:

Irregularities in the award of contracts in the Ministry of Rural Development, at least Five Hundred Million Ringgit (RM 500,000,000.00) could have been saved! MACC must conduct investigation immediately.

The Minister of Rural Development must explain the irregularities in the award of contracts in his ministry. There are reasons to suspect the existence of rampant corrupt practices. As much as RM 500,000,000.00 could have been saved had the Ministry followed the proper practice of awarding contract to the lowest qualified tenders.
I stayed up till 10.30pm in Parliament on Monday (8/11/2011) to debate and to wait for the answer from the Ministry of Rural Development with regard to the issues I had raised. I was greatly disappointed when the Deputy Minister of the Ministry refused to answer my questions.

The Rural Development Ministry is awarding 209 projects for the year 2011 and they are numbered KKLW 1/2011 – 209/2011. The Ministry has announced only the award of 129 projects. I have asked what has happened to the other 80 projects. The Deputy has refused to reply.
The projects under the ministry were given by direct negotiation, limited tender or open tender.

I have asked why projects like the Sarawak Rural Water Supply worth RM638,910,000.00 was given through direct negotiation. The Deputy has refused to give an answer. Other projects given through direct negotiation were the Sarawak Rural Water Supply recticulation system worth RM83,860,000.00 and the Sarawak Special Rural water Supply 2011/2012 project worth RM555,050,000.00

I have informed the Deputy Minister that I have received complaints that the companies that submitted the quotations for projects under limited tender category in many cases were in fact submitted by the same person using different names. The Ministry did not invite separate independent companies to bid for the job. The Deputy Minister also refused to answer whether the allegation is true. Projects No. 9–13, 23–40, 43-46, 51-56, 60, 69-75, 82-92, 100, 101, 110, 115 116, 118-124, 131, 132, 143 and 144/2011 (68 of them) were projects awarded through limited tenders.

Although open tenders were conducted for the 68 projects as listed in the schedule hereto, all were not given to the lowest priced bidder except for one. Many of them were awarded at many times more than the lowest price tendered.

The Government lost RM403,857,592.72 for its failure to give to the lowest qualified tenders. The proper way to conduct an open tender is to first determine those qualified to bid for the job. Once the qualifying criteria for the tender have been met, the contract must be awarded to the bidder who submits the lowest bid. Such a system will save the government money and be fair to all those who have make the effort to submit the tenders.
After taking into consideration, the loss the government suffered through direct negotiation and limited tender projects, I estimate the people lose at least Rm500,000,000.00 through the improper way the above said contracts were awarded.

I call on the government to award the balance projects that have yet to be given out to be done in accordance to the abovesaid accepted proper procedure of open tender system.
Unless a satisfactory answer is forth coming from the Minister, I call on the Malaysian Anti Corruption Commission (MACC) to immediately conduct investigation as the facts show prima facie that rampant corruption exists in the award of the above said contracts.

Zambry wants to cover up issue by filing a suit‏

Filing a suit does not clear the name of BN Perak MB, Dato’ Seri Zambry Bin Abdul Kadir and his administration but only goes to show that they have something to hide.

BN Perak Menteri Besar, Dato’ Seri Zambry Bin Abdul Kadir has been reported in the media yesterday (23/10/2011) that he will be filing a suit against me for my statement that he and his administration has approved a total of 68,503 acres of land since 2009 till July 2011. The statement was issued by me in pursuant to my duty as an elected representative. It was not a personal attack on Dato’ Seri Zambry but a demand by the people that he and his administration be transparent in the award of state lands.

I stand by what I have said and awaits the summons from him.

Dato’ Seri Zambry’s threat to sue me only goes to prove that he and his administration have something to hide. As a Menteri Besar he has a duty to answer to the elected representatives of the people of whom I am one. Dato’ Seri Zambry has not denied that his administration has approved the abovesaid 68,503 acres of land. My only challenge to him was to disclose the names of the recipients of the said lands and to explain why he has approved 60,561.75 acres of industrial/agriculture land at about RM375 per acre only.

Filing the suit against me only goes to show that he and his administration are not transparent and have something to hide. He hopes to silent me by filing the suit so that this matter can no longer be brought up for public discussion as it will be sub-judice. The hearing of the suit will take a few years. I expect Dato Seri Zambry to withdraw the suit after this coming 13th General Election and pay me some costs which he will be happy to do in order to avoid public scrutiny over this issue pending the 13th General Election. His action will be an abuse of the court process.

The public has the right to demand that Dato Seri Zambry and his administration be transparent and disclose the names of all the recipients of the 68,503 acres of land.

Pada jam lebih kurang 11.30 pagi ini saya akan pergi ke pejabat Suruhanjaya Pencegah Rasuah Malaysia di Ipoh untuk membuat lapuran terhadap Kerajaan BN Negeri Perak yang di pimpin oleh Dato’ Seri Zambry Bin Abdul Kadir.

Saya telah menerima maklumat yang kukuh bahawa Kerajaan BN Perak yang dipimpin oleh Dato’ Seri Zambry Bin Abdul Kadir telah meluluskan tanah-tanah berikut sejak 2009 hingga Julai 2011.

Saya telah berkali-kali dalam Dewan Undang Negeri dan melalui media meminta Dato’ Seri Zambry untuk mengumumkan dan menyenaraikan nama-nama penerima-penerima tanah-tanah tersebut tetapi beliau telah enggan berbuat demikian.

Saya mensyaki ada penyelewengan yang berlaku terutamanya tanah industri/pertanian yang diluluskan dengan harga lebih kurang RM375 seekar sahaja. Harga pasaran seekar tanah dinegeri Perak sekarang adalah sekurang-kurangnya RM20,000 seekar. Ini bermaksud jika 60,561.75 ekar dijual secara lelong terbuka Kerajaan Negeri Perak akan menerima wang sekurang-kurangnya RM1.2 billion.

Pada 17/10/2011 Dato’ Seri Zambry telah melalui satu kenyataan media telah menjelaskan bahawa tanah-tanah yang diluluskan kepada Majlis Agama Islam Negeri Perak (MAIP), Sekolah SUWA, Yayasan Perak dan agensi-agensi dan anak-anak syarikat milik Kerajaan Negeri dengan kadar nominal. Saya percaya jumlah tanah yang diluluskan kepada organisasi, agensi dan anak-anak syarikat tersebut merupakan sebahagian kecil daripada tanah-tanah tersebut yang telah diluluskan.

Demi kelulusan dan untuk memastikan bahawa tidak ada salah guna kuasa, penyelewengan dan rasuah saya hari ini membuat lapuran kepada SPRM.

Saya akan membekalkan bukti kukuh bahawa tanah-tanah yang tersebut di atas semenangnya telah diluluskan oleh Kerajaan BN sejak rampasan kuasa yang dilakukannya pada 6hb Februari 2009.

‘We Can. We Must. We Will.’

1. We can take back State authority in Perak and also to take Putrajaya.

Immediately after BN’s grab of power in Perak on 6th Feb 2009, a survey conducted showed that Pakatan Rakyat (PR) would be able to win 40 out of the 59 State Assembly seats in Perak had the State election been held then. There was outrage throughout the State and nation wide. The outrage has subsided but a survey conducted in July this year showed that PR can still win 33 out of the 59 seats if election is called.

We can take back State authority with the support of the people of Perak.

We must however, not be complacent. PR has 8 seats where we won in 2008 with less than 1,000 votes. On the other hand, we can also win big as BN has 10 seats which they won by less than 1000 votes (3 of which won by less than a 100 votes). We can win 41 seats to form a very stable government if these seats fall into our hands. PR won 31 seats in 2008. We can do it. Let’s work hard to achieve it for the people.

In every disaster, there is a silver lining. In every crisis there is opportunity. The grab of power by BN in Perak will probably be proven to be instrumental to the defeat of BN at the Federal level in the coming general elections. The people will be able to see the true self of the chief architect in the Perak power grab, Dato’ Seri Najib Tun Razak. They will not fall for his slogans. They will not give him the chance people normally do when a new Prime Minister comes to office. Similarly Dato’ Seri Zambry Bin Abdul Kadir will not have the benefit of newly assuming office as the new Menteri Besar. The people see him through and through. His thousands of banners and billboards (the largest number in the history of Perak) trying to portray himself in good light will not be able to deceive the people.

The people also see the true colours of Parti Gerakan, MCA and MIC who participated and endorsed the power grab. In every democratic country, from USA to UK to Japan, we see Prime Minister, Ministers and even police chiefs bow apologically in shame and resign from their posts if there is a scandal or failure on their part even though they were legitimately elected or appointed.

Only in Perak and in Malaysia, we see Najib and Zambry after grabbing power trumpeted their success, putting up banners and billboards to promote themselves.

2. We Must

We must rectify the situation. We must restore morality, integrity, dignity and righteousness to this beloved nation of Malaysia. If we allowed the grab of power in Perak to go unpunished, we are sending a message to our children and our children’s children that robbing and stealing are permissible so long as we achieve our purpose. A nation without morality, integrity, dignity and righteousness is doomed to fail.

We must save our nation from BN’s corruption, abuse of power and mismanagement which will eventually lead us to bankruptcy. We must strengthen the democratic institutions in our country. We must ensure transparency, good governance and democratic principles and values are upheld.

We must ensure that which has happened to the Perak State Assembly must never be allowed to occur again. We must restore the Perak State Assembly to its rightful place. We must make right the Perak crisis court cases where judges do not follow the law.

Under the impression that he is secured with the police on his side and immune from the law, Zambry has approved 60,561.33 acres of industrial/agricultural land at an average price of RM375 per acre since the grab of power. Despite repeated demands, he has refused to disclose the names of the receipients. We can only assume that most of these lands were approved to his or BN cronies. If Zambry and his or BN’s cronies were to benefit RM20,000-00 per’s acre from these approvals, they would have made a staggering RM1.2 billion far exceeding the Perak State Government’s annual budget! We must demand transparency.

Prime Minister Tun Hussein Onn expressed his worry when our nation was indebted in the sum of RM20.0 billion. Tun Mahathir has allowed it to balloon to RM238.3 billion when he left office in 2003. Tun Abdullah Badawi allowed it to grow to RM313 billion.

Today our nation is indebted to the tune of RM455 billion about 53.8% of our GDP. Argentina became a bankrupt nation when its national debt reached US95 billion (RM285 billion). Many more nations in Europe are facing bankruptcy. Malaysians must not think that our nation can never be bankrupt. Each Malaysian is now indebted about RM16,000-00 or RM80,000-00 per family of 5 persons!

2012 Budget sees us in deficit of another RM51.2 billion. Estimated income is RM181.6 billion while the expenditure is RM232.8 billion. Repayment of debt for 2012 has reached RM20.45 billion.

Unless a debt is incurred in order to earn more money, every debt incurred by us is to use up the money belonging to our future generations. We must let the people realize that the goodies given by BN during elections to cover up their excesses and corruption only add on to their sorrows to come. We do not want our children to curse us for the sufferings they have to endure due to our failure to prevent BN from making our nation a bankrupt nation.

We Will
We will together with other Pakatan Rakyat parties work tirelessly to save this nation from possible bankruptcy. We will work to enhance the quality of education and the quality of our universities. We will restore, uphold and strengthened the democratic institutions of this country. We will make Malaysia a better place for all Malaysians. We will surmount the challenges ahead of us together. We together reaffirm that we can, we must and we will take back state authority in Perak and take power in Putrajaya.

Zaki's admission voids MB vs MB trial

The Federal Court rulings on cases involving the Perak constitutional crisis should be considered void because of former Chief Justice Zaki Azmi's admission that he had no part in forming the panel which heard them, said Perak DAP.

Perak DAP chairperson Ngeh Khoo Ham said that Zaki's admission that he did not empanel the five-member panel which heard Mohd Nizar Jamaluddin's case was wrong in law.

Citing Malaysian Bar vs Tan Sri Dato Abdul Hamid bin Omar [1989] 2 MLJ page 281, he said that the Supreme Court had in 1989 ruled that a Federal Court panel can only be empaneled by the chief justice.

"By virtue of this Supreme Court decision, the highest court in the land, empaneling a Federal Court bench by any other person is not allowed.

"Therefore the Federal Court decisions in regard to the Perak crisis cases are void," Ngeh (right) told Malaysiakini.

Only CJ can constitute panel

In 1989, the case of the Malaysian Bar against former Lord President Abdul Hamid Omar, the Federal Court had ruled that only the lord president alone is entitled to convene and empanel judges to constitute the Supreme Court for any sitting.

"The powers of the lord president or any person acting as lord president under Section 38 and 39 of the (Courts of Judicature Act) are express statutory powers which cannot be exercised by others unless properly exercised under s 9(1) of the Act during illness or absence from Malaysia or owing to any other cause when the lord president is unable to exercise the functions of his office.

"We read the words 'any other cause' in s 9(1) to relate to physical inability in the sense that the lord president is unable to perform his functions," read the judgment.

In an interview with Malaysiakini on Sept 12, Zaki had said he had instructed his deputy, Court of Appeal president Alauddin Md Sheriff, to handle the Perak crisis related cases when it came up to the Federal Court.

Zaki said that he did not want to be involved in the cases as he did not wanted to be accused of conflict of interest as he had once been heavily involved with Umno.

"I did not sit on any cases which were not only political, but had a flavour of politics. I did not even constitute the panel. I told my Number Two: 'You go to constitute (form) the panel. I don't want'," said Zaki.

'New CJ must right wrongs'

Ngeh, who is a senior lawyer, argued that since the decisions of the Federal Court were now void, it was incumbent upon the current Chief Justice Ariffin Zakaria to constitute a new panel to hear Nizar's case.

"Since the Perak cases have not been disposed off, we call upon the present chief justice, to convene a new panel, to review the decisions that have been made by the earlier unlawfully convened Federal Court hearing," he said.

In the same vein, Ngeh said Zaki's (left) revelation in the same interview that a court registrar had arranged for a single Court of Appeal judge to hear Zambry Abdul Kadir's application on May 12, 2009 had also raised questions.

"How can a registrar have the powers to call on a Court of Appeal judge to hear a case?" said Ngeh, explaining that such powers lie with the Court of Appeal president.

On May 11, the Kuala Lumpur High Court ruled in favour of Nizar's application to be declared the legitimate Perak menteri besar.

But in less than a day, Zambry managed to obtained a stay of execution order from the Court of Appeal. His application was heard by a single judge - Justice Ramly Ali - despite there being two three-member panels hearing cases that day.

This fact, along with the swiftness in which the stay was granted, has led Nizar and his counsel to question the court's integrity.

On polling day they will be allowed to vote using their Mykads because nobody will know that their Mykads are fake ones. As their names appear in the Voters’ list, they will be allowed to vote.

It is a well known fact that many foreigners have been able to obtain Mykads with ease. The complaints I receive is that it will be easier for foreigners to obtain the Malaysian citizenship if they are Muslims.

It has been so difficult for many Malaysian born residents to obtain citizenship for various reasons. Just like the case of Chan Ming Ying, aged 31 who was born in Malaysia and has been living in Malaysia whole of his life. He studied in Sekolah Rendah (c) in Sg Batu and Sekolah Menengah Pantai Remis both in Perak and subsequently in the Johor Bahru Polytechnic. His only ‘sin’ is that his Chinese parents adopted him without going through the proper legal procedure. His adoptive Chinese parents have put their names into his birth certificate as the natural parents which is quite a common practice. His case was detected because his natural father was a Chinese and mother an Indian. His natural parents can no longer be traced. So, his skin is a little darker and therefore, the NRD refused to recognize him as a citizen. He is now a state less person holding a green card which allow him to stay in Malaysia only temporarily.

I call on the Home Minister and the Election Commission to clarify and rectify the above said matters.

Zambry responsble for Belum forest clearing and approval of 68,503 acres of land‏

Dato’ Seri Dr Zambry Abd Kadir must come clean with regard to the clearing of 74 ha of land at Sungai Mendelum area in the Royal Belum and the Temengor Forest Reserve and the 68,503 acres of land which he has approved since the grab of power by BN on 6Feb. 2009.

Dato’ Seri Dr Zambry Abd Kadir, BN Menteri Besar of Perak must own up to the clearing of 74 ha (183 acres) of land at Sungai Mendelum area in Royal Belum and the Temengor Forest Reserve and the approving of 68,503 acres of land since he becomes MB of Perak.

Perak Forest Department Director, Datuk Nik Mohd Shah Nik Mustafa has confirmed that the BN Perak State Government has approved the logging of the above said 74 ha of land. Zambry has approved or alienated so much land away in the last 2 ½ years that he has no knowledge of the locations of the lands he has approved.

Logging has also been rampant in many areas and I have received complaints from locals that rampant logging activities have been carried out in Segari and Beruas.

Internal sources have informed me that Dato’ Seri Zambry has approved a total of 68,503 acres of land since the grab of power in Feb 2009 till July this year! 60,561.75 acres of which are industrial or agricultural land which was approved at the rate RM375 per acre! Obviously the cronies who received such lands will reap huge profits. They are expected to reap profit of at least 40 times the premium paid. The cronies will profit a staggering RM900,000,000 which is more that the Perak State Government annual budget of about RM800 million ! Despite repeated requests at the State Assembly sittings, he has refused to disclose the recipients of these lands.

Under the Pakatan Rakyat Government we only approved land to the landless and the poor at the nominal premium of RM1,000 per ha. All lands approved for commercial farming will be by open tender which will reap in much higher premium for the people.

I believe that Dato’ Seri Zambry has no confidence that BN will win in the next general election or be retained as the Menteri Besar. As such he and his cronies hope to reap as much benefit as possible before the 13th General Election. He will leave behind a host of problems when his cronies who have been alienated the lands or those who bought from them institute eviction proceedings against the farmers who have toiled on their lands for decades.

I challenge him to clear his name with regard to the above matters.

Illegal for Government to subject non-Muslims to be tried by the Syariah Court. Call on the Government to resolve the problems related to the conversion in and out of Islam immediately and to implement a quick and easy way to determine the religious status of a person

The clarification by Minster in the Prime Minister’s Department, Mejar Jeneral (B) Datuk Jamil Khir Bin Baharom that the 135 applicants who managed to renounce Islam were actually non-Muslims who were mistakenly registered as Muslims by the National Registration Department (NRD) because of their names and these victims have to apply to the Syariah Court to change their religious status shows that something is very wrong with the Government administration.

Firstly, if it is a mistake made by the NRD why can’t the NRD rectify it?

Secondly, the Syariah Curt has no jurisdiction over non-muslims. The Syariah Court Judges should reject such application due to lack of jurisdiction and asked that the matter be resolved by the NRD. Any decision by the Syariah court over a non Muslim is illegal.

Thirdly, courts are constituted to settle disputes not for confirming the religious status of a person. Articles II of the Federal Constitution guarantees the freedom of religion of every Malaysian and therefore, the religious status of a person is determined by the person concern. A statutory declaration made by the person should suffice. Muslims are complaining that there is huge back log of cases in the Syariah Courts. Therefore, Syariah Courts should spend their time giving priority clearing the cases rather than getting themselves involved with matters which they do not have jurisdiction.

Subjecting non-Muslims to the Syariah Court is oppressive as these non-Muslims have to go through ‘counselling not to leave the Islamic faith’ which may take months, some cases years and in many other cases never approved.

A person after becoming a Muslim registers himself/herself with the respective State Islamic Council. Depositing a statutory declaration declaring that he/she has left the Islamic faith with the same Islamic Council should suffice to confirm that he/she has left the Islamic faith.

Conversion to Islam has been abused by many. Some have converted to Islam to escape their legal duty to provide maintenance for their wives and children. Others converted to Islam to get custody of the children as the Syariah Courts will grant them the custody of the children. The civil courts regretfully now hold the view that they have no jurisdiction to interfere. Islam promotes justice but it has now been used to perpetuate injustice.

I know of people who do not profess the Islamic faith, never seen or read the Koran before and have never entered a mosque but due to various circumstances have a muslim sounding names. They want to be non-Muslims and get married to non-Muslims. Since there is no avenue for them to get married, they stay together out of wedlock and give birth to offsprings who will then be victim of circumstances like their parents. By refusing them an avenue to get married and have a normal family, we become a cruel society and by our cruelty we breed further social problems.

All persons above the age of 18 should be given full liberty to choose the religion of their choice.

I call on the Government to resolve the issues related to the conversion in and out of Islam immediately by following and respecting the provisions and the spirit of the Federal Constitution so that the untold miseries of those affected by the said issue can be put to an end.

Call on Dato’ Mah Hang Soon Perak BN government Exco member in charge of local governments to solve the public transport woes in Manjung and other districts. PR is willing to offer its services for the sake of the people to solve the public transport woes though the state power has been taken from them.

One of the top priorities when PR Perak became the state government in March 2008 was to solve the woes of public transportation in Perak. There were no flight services to Perak and bus services were poor or non-existent in many areas.

BN Perak Government had been debating for years whether to extend the Sultan Azlan Shah Airport and whether to build the Ipoh Central Public Transportation Hub in Perak. Meanwhile, the people of Perak were without flight services and public bus transport were poor or non-existent in many areas.

PR Perak Government sprang into action and concluded a deal with Firefly to fly between Ipoh, Singapore and Subang. Firefly is now flying regularly 2 flights a day in and out of Ipoh.

PR Perak government also gathered all the bus operators in Kinta Valley to form a company called The Combines Bus Services Sdn Bhd, which then concluded a deal with the Perak State Government to build the Ipoh Central Public Transportation Hub in Meru Raya. 250 new buses would replace the old buses and they will be plying Kinta Valley and to other parts of Perak and Malaysia within 2 years from the date of the Agreement.

PR Perak government was also finalizing an Agreement with a developer to develop Manjung Central public Transportation Hub in Seri Manjung in the Manjung District but the same was abruptly terminated with the grab of power which occurred on 6th February 2011.

More than 2 years have lapsed but we see very slow progress of Ipoh Central Public Transportation Hub taking shape. Old buses in Ipoh have yet to be replaced.
Last year, the BN Government announced a subsidy of RM70,000.00 per month for a bus company to operate in Manjung District and it was to commence operation the beginning of this year but nothing has materialized. The poor especially those who are sick continue to suffer. They could not go to the hospital with the cheaper mode of public bus transport. Many have to pay as much as RM30 per trip to the Manjung Hospital using taxis.

If BN Government does not know how to solve the public transport problem, the Pakatan Rakyat is willing to offer its services for the sake of the people though the state power has been taken away from us.

国阵政府已宣布公共巴士服务将在今年初开始实行，但是现在已经到了六月，我们还看不到任何的进展。

民联霹雳州政府已减少不必要的程序，并能在一个月内发出所申请的土地续期租约。我接到很多投诉，在国阵管理下，这些土地续期租约经过两年还没发出。

我呼吁拿督斯里赞比里真正为人民服务，而不是发布乐观的公告以欺骗人民。我希望人民可以清楚地看到，国阵攫取霹雳州是为了权力，而不是为人民服务。

Perak Eco Industrial Hub is another “pie in the sky” announcement by BN perak Government. Dato’ Seri Zambry bin Abdul Kadir should prove himself by solving the simplest of the state problems like public transportation in his own house district of Manjung and issuing titles for renewal of expired leases within 1 month as was done by the PR Perak State Government.

The announcement by Dato’ Seri Dr. Zambry bin Abdul Kadir, BN Menteri Besar of Perak that an Eco Industrial Hub will be set up in Perak is another BN Perak Government’s “pie in the sky” announcement.

BN Perak Government is well known for making “pie in the sky” announcements of mega projects that never materialize. Amongst them, multi-million and multi-billion ringgits projects such as the Aluminium Plant, Gulf Petroleum Project, International Halal Meat Hub, Aerospace Tourism from the Ipoh Sultan Azlan Shah Airport, building luxury homes in Tronoh where residents own personal planes, producing ethanol from mangrove palms (Nipah) and the seaweed project. The list can go on.

BN Perak Government tries to give the impression that it has brought much development to Perak to deceive the people when in fact it has failed to do so. An inquiry from an interested investor is announced as if the project is taking off in Perak.

The PR Perak Government announced a project only after the details have been worked out and the project is ready to be launched.
BN Perak Government under Dato’ Seri Zambry cannot even solve the simple transport problem of his home district of Manjung.

The BN Government has announced last year that the public bus service will start operating at the beginning of this year but we see nothing out of the announcement though we are entering the month of June.

PR Perak Government has cut down unnecessary procedures and was able to issue new titles for renewal of expired land leases within 1 month after an application is made. I have received numerous complaints that such titles could not be issued even though 2 years have lapsed under BN rule.

I call on Dato’ Seri Zambry to actually serve the people rather than making rosy announcements to deceive the people . I hope the people can see clearly that the BN grab of power in Perak is for power and not to serve the people.

Education Minister, Muhyiddin will fail his Form 3 Maths and Science if tests conducted in Mandarin or Tamil.
- Call to stop the abrupt change of medium of instruction from next year for Maths and Science in Malaysian schools

The pupils attending national primary schools have been learning their Mathematics and Science in English since Primary One after the then Prime Minister, Tun Dr Mahathir Mohamad decided in 2003 to have the students study these subjects in English. The Government spent RM5.0 billion for the exercise!

The BN Government has now decided that these students will have to study these subjects in the Malay language when they enter Form 1 (Secondary school) next year. This is just absurd and ridiculous.

If our Education Minister who is also our Deputy Prime Minister, Tan Sri Dato’ Haji Muhyiddin Bin Mohd Yassin cannot see how absurd and ridiculous the decision that was made, I challenge him to sit for a Form 3 test on these two subjects in Tamil or Mandarin. I am certain he will fail.

I call on the Government to allow these students to continue their Mathematics and Science in English which has been their medium of instruction since Primary One.

教育部长慕尤丁的初中三数理考试将会不及格，如果这项考试是用华语或淡米尔语进行。
-呼吁从明年开始，在马来西亚学校，停止对数理科目，改换教学的语言。

之从前首相敦马哈迪医生决定在2003年用英语教数理，学生已从小学一年级开始，用英语学习数理。政府在这项措施，花了马币五十亿！

国阵政府如今决定，当这些学生明年升上初中一时，必须用国语学习这些课目。这是荒谬及可笑的。

如果我们的教育部长，也是我们的副首相，丹斯里慕尤丁看不出他的决定是多么荒谬和可笑的，那么我挑战他在初中三的数理考试里，用华语或淡米尔语进行。我肯定他不会及格。

我呼吁政府让这些学生升上中学时，继续使用英语来学习数理。因为这是他们从小学一年级开始，用来学习数理的语言。

BN Perak State Government fixing 23rd January 2011 to celebrate Christmas defeats the spirit of celebrating the event.

I note with regret that the Perak BN Government deems it fit to celebrate Christmas 2010 out of season to celebrate it only on 23rd January 2011. Christmas is celebrated worldwide on 25th December 2010.

The purpose of a celebration is to observe the significance of an event, in our instant case the birth of Christ. Apart from that, a celebration uplifts and liberates the human spirit to bring happiness, gladness and joy.

The people of Perak are starting to feel the mood of celebrating Chinese New Year which falls on 3 February 2011. Therefore, to celebrate Christmas only on 23 January 2011 when the people are in the mood of celebrating Chinese New Year will overshadow the message and significance of the Christmas event. The festivity which Christmas brings to uplift the spirit of the people will also be lost.

I hope in future the State Christmas program will be celebrated during the season of Christmas.

我对国阵霹雳州政府在2011年1月23日过了圣诞节后才庆祝感到遗憾。全球都在2010年 12月25日庆祝圣诞节。

庆祝会的目的是在于认识基督诞生的重要意义。此外，庆祝会可提升和解放人的精神，带来幸福，欢乐和喜悦。

霹雳州的人们开始感受到于2011年2月3日庆祝农历新年的气氛。因此，在2011年1月23日庆祝圣诞，圣诞节的意义和气氛将会被庆祝农历新年的气氛所掩盖。而欢庆圣诞给于提升人的精神也将丢失。

我希望在今后，州的圣诞庆祝活动将在圣诞节举行。

BN Perak State Govt promoting falsehood in a religious event‏

Dato Mah Hang Soon must not be allowed to promote falsehood in a religions event. The public demand a product as advertised, not a fake one.

On 6th January, BN Perak State Government Executive Councilor, Dato’ Dr Mah Hang Soon announced that the well-known Christian Music group, Hillsong from Australia will take centre stage during the Perak State level Christmas and New Year celebrations at Stadium Indera Mulia in Ipoh on 23rd January, 2011.

Immediately, on the same day, the manager of Hillsong Music, Australia Mr. Timothy Whincop issued a letter confirming that the group performing at the event is not sanctioned or endorsed by Hillsong Music or Hillsong Church.

I have been given to understand that this matter has been brought to the attention of Dato’ Dr Mah. Despite the said knowledge he insisted that the group performing on 23/1/2011 be promoted as from Hillsong from Australia.

Yesterday, Hillsong issued another letter confirming that Hillsong is not and will not be performing in any event in Ipoh, Perak on 23/1/2011 and reiterates that Hillsong’s name may not be used without prior permission. Copies of their letters dated 6/1/2011 and 12/1/2011 are attached herewith.

Christianity promotes truth and respect for the rights of others. It is a shameful affair for Dato’ Mah to promote falsehood.

Dato’ Mah must let the public know exactly who is performing at the Christmas event. As the exco member in charge of consumer affairs, Dato’ Mah has the duty not to mislead the public but to describe a product accurately.

Christians and other Malaysians are upset that Dato’ Mah is not telling the truth. The public demand that they get the product as advertised, not a fake one.

BN seems to be planning a one day sitting again from the agenda sent to Perak State Elected Representatives.

BN seems to be planning a one day sitting again from the agenda sent to Perak State Elected Representatives. Pakatan Rakyat Elected Representatives call for sufficient time to be allocated for elected representatives to debate the matters before the House for this coming State Assembly budget sitting commencing on 30/11/2010.

Last year the Perak 2010 budget was past without debate in 20 minutes by BN elected representatives because Dato’ R. Ganesan position as a Legitimate Speaker was in question and they do not allow that question to be raised.

In the last sitting on 3/8/2010, the BN appointed speaker, Dato’ Ganesan intentionally did not want allow the PR elected representatives to speak on behalf of the people. He decided that the sitting should be for one day only and allow opposition leader Dato’ Seri Mohd Nizar Bin Jamaluddin (who should rightfully the Menteri Besar) only 15 minutes to speak. The Pakatan Rakyat elected representatives protested as it makes a mockery of the State Assembly. Traditionally, there is no time limit imposed on the opposition leader to bring the State matters before the house just as no time limit is set for the Menteri Besar. So long as the matters spoken are relevant and relate to the State of Perak they would be allowed. On one occasion, I spoke for 3 hours as opposition leader and when PR was in government Dato’ Seri Tajol Rosli as opposition leader spoke for 2 ½ hours.

The PR elected representatives protested as they were expected to be given much lesser time to debate especially matters pertaining to their respective constituencies.

Dato’ Ganesan and the BN Perak Government accused the PR elected representatives of making a scene when our objection was to defend democracy. BN Perak Government had planned to make the State Assembly a rubber stamp without a debate. They use hundreds of police to surround and control the State Assembly to ensure that the State Assembly will be a mere rubber stamp to approve what they want.

Just like the last sitting where the matters to be transacted for that sitting were contained in a one day agenda, and subsequently all matters were approved within the same day, all matters that needed to be transacted in this coming State Assembly sitting are also listed a one day agenda.

The matters to be transacted are as follows:-

1. Oral Questions Session.
2. To pass the Perak Malays Higher Studies Scholarship Fund (Amendment) bill.
3. To pass the Perak Nationals (Non-Malay) Scholarship Fund (Amendment) Bill.
4. To pass Wood – based Industries (Amendment) bill.
5. To pass the supply 2011 bill (Budget) amounting to RM832,417,100.
6. To pass a motion to approve the use of RM273,000,000 from Consolidated Development Fund and
7. To pass a motion to approve the Perak Constitutional Amendment to include 4 other titled Raja (Raja Kecil Besar, Raja Kecil Sulong, Raja Kecil Tengah, Raja Kecil Bongsu) as members of the Dewan Negara.

The Perak State Assembly will become meaningless if the above said matters are past in a day without meaningful debate.

The BN Perak Government is expected again to use the police force to ensure that they will achieve their purpose in passing the above said matters without being questioned.

I call on Dato’ Ganesan to declare that he will allocate at least 4 days for debate and call on the BN Government to support my call.

If BN fails to restore democracy in Perak, let the people of Perak oust them decisively in this coming general election.

Corrupt practice suspected in drastic drop in timber revenue.

BN Perak State Government must explain why the revenue from timber concessions given out in 2009 is only RM12.3 Million while the revenue in 2008 under Pakatan Rakyat was RM40.0 Million

Every year the Perak forestry department allows 7,000 hectares of timber concessions to be approved (on a sustainable basis). Despite the acreage being the same the following are the timber concessions revenue for the last 5 years received by the Perak State Government.

2005 RM15.14 Million (under BN)
2006 RM13.65 Million (under BN)
2007 RM16.00 Million (under BN)
2008 RM40.00 Million (under PR)
2009 RM12.30 Million (under BN)

The above figures clearly show that under the PR Government with its open tender system the State Government receives up to more than 3 times in revenue compared to BN’s system of awarding timber concessions directly to the cronies. The PR Government channel this additional income to benefit the people of Perak while only certain individuals benefited from BN crony system. It is well known fact that BN politicians will have a share from the profits made by their cronies.

The above said figures also clearly show that all these years BN politicians and their cronies have been benefiting from their direct award system at the expense of the people.

I call on Dato’ Seri Zambry Bin Abdul Kadir to explain why the drastic drop in revenue received from the timber concessions given out by the State Government, from RM40.00 Million in 2008 (when under PR) to only RM12.30 Million in 2009 (when under BN).

I also call on the Malaysian Anti Corruption Agency (MACC) to act swiftly to investigate if corrupt practices are involved. We see MACC acting swiftly in Selangor (PR State) when only a small sum is allegedly involved. I expect MACC to act more swiftly in Perak as the amount involved is many more times than the amount allegedly involved in Selangor cases. However, many people have expressed cynicism because the suspected corruption involved BN politicians. Many believe that MACC will only act against BN politicians if it gets the nod from the BN political masters.

Perak Pakatan ready for snap polls, says Ngeh

AYER TAWAR, Nov 17 — Perak Pakatan Rakyat (PR) has finally recovered from its bruising fall from government last year, declaring itself ready to take on the Barisan Nasional (BN) should snap polls be called soon.

Unlike in other states, the PR pact in Perak is said to be the most cohesive of the lot, bound together by the year-long constitutional impasse that rocked the state following BN’s infamous power grab in February 2009.

In an exclusive interview with The Malaysian Insider, newly re-apppointed Perak DAP chairman Datuk Ngeh Koo Ham said that since the power grab, all state PR leaders and members have been working themselves to the bone to ensure another victory in the next general election.

“Our PR brothers are very close here in Perak, not just because of the crisis but because we have very good, sound, matured and very capable leaders.

“And yes we are [ready to face elections]. In fact, we have been on election-mode since the power grab. And now that the election can be called anytime, we are ready.

“I believe our general election machinery is still in tact,” he said, when met at his office here yesterday.

Ngeh admitted however that due to the series of events during the constitutional crisis in Perak after the power grab, the PR machinery now desperately needed to raise more funds and quickly.

“When our machinery is enriched, then we can move smoothly. We have spent a fair bit on our expenses, especially when paying costs to BN during the court cases,” he explained.

The Perak PR has been engaged in a mountain of legal suits against the BN since February last year, during its many attempts to declare BN’s rule in the state as unconstitutional.

Despite this however, Ngeh, who was formerly a senior state executive councillor in the Perak PR government, claimed that PR has been making inroads with the more rural population in the state, where it had lost greatly to BN during Elections 2008.

In the March 2008 political tsunami, the traditionally BN-helmed state of Perak fell to the hands of the opposition with a narrow three-seat margin.

DAP had swept up all 18 state seats it had contested, primarily in the urban Kinta Valley area, while PKR had managed to win in seven seats and PAS, in six.

BN had managed to score 28 seats, thanks to Umno’s popularity in the more rural Malay-dominated areas in the silver state. MCA only won in one state seat while MIC failed to secure any.

In the early hours of March 9, 2008, the three opposition parties of DAP, PAS and PKR came together in a hasty meeting and made an agreement within an hour that it would form a tripartite government in Perak.

Due to the defections of three PR assemblymen however, the government fell back to the BN in February 2009 and the state was plunged into turmoil for over a year.

Today, after exhausting all avenues to seek legal redress over the power grab, PR has now set its sights on recapturing Perak from BN in the coming general election, said to be held early next year.

This Saturday, the BN supreme council will meet to chart campaign plans for a possible snap polls widely speculated for the first half of 2011.

In Perak, PR’s greatest hurdle is the Malay vote, particularly in the semi-urban and rural areas contested by Umno in Elections 2008.

But Ngeh remains confident that coupled with the injustice of BN’spower grab and PR’s 10-month performance in Perak, PR’s influence with the Malay voters has now greatly improved.

“We believe and hope that we already now have at least 40 per cent of support from the Malays in the rural areas.

“Ideally, our target is not to win with just a majority of three seats. This time, we aim to win two thirds of the 59 state seats in Perak,” Ngeh declared.

He claimed that the Malay ground was now “ripe and open” to the opposition, judging from the general sentiment of voters in the traditional Umno strongholds.

“It is a great transformation. Before March 2008, the DAP could never even raise our flag there. We could not even enter their territory.

“But now, they welcome me and when I come, I speak to a crowd of two thousand people. I feel very welcomed,” he said.

DAP, he said, was no longer considered a “Chinese chauvinist party or a Communist party”.

Similarly, Ngeh added, voters in the Chinese community, no longer feared non-Chinese centric parties and were now in acceptance of multiracial parties like PKR and even Islamist party PAS.

“This is why what we are doing now is to ensure that there is non-Malay support for PKR and PAS in the areas where DAP is not contesting.

“We are persuading the Chinese not to fear these parties and we have been moving to infiltrate all the deepest recesses of Perak,” he said.

Strategically, Ngeh said the PR alliance already has its presence in all 24 parliamentary constituencies in Perak.

“We have formed PR liaison committees in every parliamentary constituency, represented by nine members – three from each party,” he explained.

For DAP, Ngeh added, there were at least one or more branches in each area.

“That is why, we always have people moving on the ground there, working the ground and helping us to mobilise our functions when we plan any,” he said.

He added that each PR party is also expected to provide service in the areas that they would likely be contesting in the coming elections.

The seat distribution among DAP, PKR and PAS, he added, would likely be the same as the last general election.

“It is not a problem for us. It is true that DAP gave up two seats to PKR to contest but we are not fighting among ourselves for the seats. What is important is that our relationship is sound.

“That is why Perak PR is so close... your area is considered my area and we count ourselves as PR leaders, not just leaders of our own respective parties,” he said.

In Elections 2008, DAP contested in 18 seats, PKR in 20 seats and PAS in 21 seats.

Ngeh added that it was a general consensus among PR leaders that former Perak Mentri Besar Datuk Seri Mohammad Nizar Jamaluddin, a PAS man, would be retained as the Mentri Besar.

“We look at merit and Nizar was a sterling leader and a great Mentri Besar. In fact, when Nizar said, as an MB, that he would administer the state irrespective of race or background, I knew I would support him all the way, we do not even need to discuss policies,” he said.

PRU: Pakatan Perak sudah sedia tumbang BN, kata pengerusi DAP

AYER TAWAR, 17 Nov - Empat hari ini selepas pemilihan sengit, DAP mengisytiharkan Pakatan Rakyat Perak sudah bersedia untuk menghadapi Barisan Nasional (BN) jika pilihan raya umum tergempar diadakan dalam waktu terdekat.

Berbanding negeri-negeri lain, Pakatan Rakyat Perak dikatakan lebih padu di sebalik krisis politik yang menimpa negeri itu awal tahun lalu, menyebabkan kerajaan negeri jatuh ke tangan BN.

Pakatan Rakyat masih melihat perubahan awal 2009 sebagai satu bentuk ‘rampasan kuasa’ oleh BN, yang turut membawa kepada krisis perlembagaan negeri.

Dalam temu bual eksklusif, Pengerusi DAP Perak yang baru Datuk Ngeh Koo Ham berkata, sejak ‘rampasan’ kuasa lebih setahun lalu, kesemua pemimpin dan ahli Pakatan Rakyat di negeri terus-menerus bekerja keras untuk memastikan satu lagi “kemenangan”, yang lebih besar berbanding 2008, dalam pilihan raya umum ke-13.

“Saudara-saudara kami dalam Pakatan Rakyat, kami sangat rapat di Perak, bukan hanya disebabkan krisis tetapi disebabkan kami mempunyai pemimpin-pemimpin yang baik, disegani, matang dan berupaya.

“Dan, ya, kami sudah bersedia (untuk menghadapi pilihan raya umum). Sebenarnya kami berada dalam persekitaran pilihan raya sejak (kuasa) kerajaan negeri disambar. Dan, sekarang pilihan raya akan dipanggil pada bila-bila masa, kami sudah bersedia.

“Saya percaya jentera pilihan raya kami berada dalam kedudukan mantap,” kata beliau kepada The Malaysian Insider di sini.

Bagaimanapun Ngeh mengakui, ekoran siri peristiwa ketika krisis perlembagaan selepas kuasa kerajaan negeri disambar, jentera Pakatan Rakyat kini amat terdesak untuk mendapatkan lebih banyak dana dan dalam kadar secepat yang mungkin.

“Apabila jentera kami diperkaya, maka kami boleh bergerak dengan lancar. Kami telah membelanjakan jumlah yang banyak bagi membiayai perbelanjaan khususnya untuk membayar kos kepada BN ketika kes mahkamah,” kata beliau.

Pakatan Rakyat Perak terlibat dalam siri kes mahkamah ke atas BN sejak Februari 2009, dalam usaha mengisytiharkan kerajaan negeri sebagai tidak sah.

Pun begitu, bekas exco kerajaan negeri kanan Perak ini berkata, pihaknya sudah berjaya menyaksikan kemajuan dalam menerokai sokongan di kalangan pengundi kawasan luar bandar di mana ia kalah besar di tangan BN pada 8 Mac 2008.

Pada 2008, Perak yang secara tradisi dikuasai, BN jatuh ke tangan pembangkang dengan perbezaan hanya tiga kerusi.

DAP menyapu bersih di kesemua 18 kerusi yang ditandingi khususnya di kawasan Lembah Kinta manakala PKR menang di tujuh kerusi manakala PAS pula enam.

BN pula terus bertapak di 28 kerusi, kebanyakannya di kawasan luar bandar yang majoriti adalah pengundi Melayu. MCA menang satu kerusi manakala MIC kalah teruk.

PKR, DAP dan PAS membentuk kerajaan negeri Pakatan Rakyat pada awal pagi 9 Mac 2008 - sehari selepas pengundian.

Bagaimanapun kerajaan negeri Pakatan Rakyat tumbang ekoran tindakan tiga wakil rakyatnya - dua dari PKR dan seorang pemimpin DAP keluar dan mereka bertindak sebagai anggota mesra BN.

Selepas siri usaha perundangan untuk memperoleh kembali kuasa kerajaan negeri, Pakatan Rakyat Perak kini memberi tumpuan untuk mendapatkan semula kemenangan dalam pilihan raya umum tergempar yang dijangka diadakan tidak lama lagi.

Dewan Tertinggi BN akan mengadakan mesyuarat Sabtu ini, dijangka memberi tumpuan ke atas persediaan menghadapi pilihan raya umum ke-13 dan konvensyen mereka.

Di Perak, halangan besar Pakatan Rakyat ialah mendapatkan undi orang Melayu khususnya di kawasan-kawasan separa bandar dan luar bandar yang ditandingi Umno pada pilihan raya umum 2008.

Bagaimanapun Ngeh kekal yakin bahawa disebabkan gabungan ketidakadilan yang disebabkan oleh BN dan prestasi kerajaan negeri Pakatan Rakyat selama 10 bulan, pengaruh mereka di kalangan pengundi terus mengalami peningkatan.

“Kami percaya dan berharap bahawa kini kami memiliki sekurang-kurangnya 40 peratus sokongan pengundi Melayu dari kawasan luar bandar,” katanya.

“Secara ideal, sasaran kami bukan untuk menang dengan majoriti tiga kerusi. Kali ini, kami meletakkan sasaran untuk menang dua pertiga daripada 59 kerusi Dewan Undangan Negeri di Perak,” kata Ngeh.

Ngeh juga mendakwa berdasarkan pada sentimen umum pengundi di kawasan-kawasan kuat Umno, pengundi-pengundi Melayu kini lebih terbuka ke arah Pakatan Rakyat.

“Ia satu perubahan besar. Sebelum Mac 2008, DAP tidak boleh menaikkan bendera di kawasan-kawasan itu. Kami tidak boleh masuk langsung wilayah mereka.

“Tetapi sekarang, mereka mengalu-alukan saya dan apabila saya datang, saya bercakap kepada kehadiran sekitar 2,000 orang, saya merasakan diri saya dialu-alukan,” kata beliau.

DAP, kata beliau, sudah tidak lagi dianggap sebagai parti “cauvinis Cina atau parti komunis.”

Begitu juga sebaliknya kata Ngeh sambil menambah, pengundi komuniti Cina juga sudah tidak bimbang dengan parti-parti berorientasikan bukan Cina.

Kata beliau, mereka sudah mula menerima parti-parti pelbagai kaum seperti PKR dan PAS yang berlatarbelakangkan dasar Islam.

“Ini yang kami lakukan sekarang bagi memastikan ada sokongan bukan Melayu bagi PKR dan PAS di kawasan yang DAP tidak bertanding,” katanya.

Kata beliau, pihaknya kini dalam proses memujuk masyarakat Cina agar tidak bimbang dengan kedua-dua parti itu dan sedang bergerak untuk melepasi halangan-halangan sedemikian di Perak.

Bercakap mengenai strategi, kata Ngeh, gandingan Pakatan Rakyat sudah ada perwakilan di kesemua 24 bahagian Parlimen di negeri itu.

“Kami sudah membentuk jawatankuasa perhubungan Pakatan Rakyat di setiap kawasan Parlimen, diwakili oleh sembilan orang, dengan tiga wakil daripada setiap parti,” kata beliau.

Tambah beliau, setiap parti komponen Pakatan Rakyat juga dijangka menyediakan perkhidmatan di kawasan yang kemungkinan mereka akan bertanding dalam pilihan raya umum ke-13.

Ngeh juga berkata, peruntukan kerusi membabitkan ketiga-tiga komponen Pakatan Rakyat dijangka sama seperti dua tahun lalu.

“Ia bukan satu masalah bagi kami. Benar, DAP menyerahkan dua kerusi kepada PKR, tetapi kami tidak bergaduh sesama kami untuk kerusi.

“Apa yang penting ialah hubungan kami kukuh. Itu sebabnya, Pakatan Rakyat Perak sangat rapat... kawasan anda dianggap sebagai kawasan kami dan kami melihat kami sebagai pemimpin Pakatan Rakyat, bukan hanya pemimpin parti sendiri,” kata beliau lagi.

Pada 8 Mac 2008, DAP bertanding di 18 kerusi, PKR di 20 kawasan manakala PAS pula 21.

Ngeh says jealousy behind ‘dictator’ label

AYER TAWAR, Nov 18 — Datuk Ngeh Koo Ham, who easily won re-election last weekend as Perak DAP chairman, is claiming that jealousy is behind the widely-held perception that both he and his cousin Nga Kor Ming are dictators.

In an exclusive interview with The Malaysian Insider earlier this week, the veteran leader, who is now into his seventh term as state party chairman since 1998, lamented that the term “dictator” was likely pinned on him by people who disliked him and Nga were jealous as they had become so popular in the party.

Describing it as the scourge of Malaysian politics, Ngeh pointed to the example of the father-son team of DAP adviser Lim Kit Siang and DAP secretary-general Lim Guan Eng.

“We see it often in Malaysian politics. And like Lim Kit Siang and Lim Guan Eng, even though they have both served time in prison, people call it a dynasty.

“What dynasty, I would like to ask? I would like to point to the example of how the church preaches that a pastor who does not push his son to become a pastor like him is not setting a good example. Because being a pastor is a sacrificial position and before you ask someone else to sacrifice, you have to be willing to sacrifice your own son first,” he charged.

He pointed out that Kit Siang’s willingness to sacrifice his own son in prison to fight for the rights of the people should be considered as “exemplary” instead of a “dynasty”.

“I know them so well. They have sacrificed so much for the people and both even went to prison for it,” he said.

Ngeh noted that the reason why both he and Nga were accused of being dictators was purely psychological as it played on the basic human instinct of jealousy.

“It is just about that... the basic human instinct: jealousy. They see us up there as cousins and they call us dictators because we are both in power and we are cousins.

“It is totally unfair,” he said.

Ngeh (picture) pointed out that if he was a substandard party leader and had a bad track record, he would not have been voted back into power during Sunday’s polls.

“If Ngeh and Nga are lazy, if Ngeh and Nga are corrupt, if Ngeh and Nga are seeking benefits for themselves and not sacrificing, if Ngeh and Nga are not doing work, if Ngeh and Nga are for any reason, negative, then by all means reject us.

“But do not reject us when we have been sacrificing so much; our time, our money, our family and personal lives, do not reject us simply because we are cousins... it is totally unfair,” he said.

Ngeh added that the negative perception of him and Nga had prolonged because they had always chosen not to react to accusations.

“I have said that I would willingly suffer the injustice of being denied the right to reply and be subject to hurtful attacks assailed against me than to put my party in jeopardy and cause the mission of the people to be derailed.

“A good soldier is willing to keep a secret to safeguard a nation and risk being shot. This bad impression is given because I do not reply in the media. But it is a cost I would rather pay than to speak on the outside and cause the whole party to suffer,” he said.

Ngeh acknowledged that the accusations had begun even during the time when Pakatan Rakyat helmed the government in Perak, noting that they were merely “a pack of lies”.

Among others, former PKR assemblymen Jamaluddin Mohd Radzi and Mohd Osman Mohd Jailu, had levelled numerous complaints against both Ngeh and Nga, claiming that the duo often bulldozed decisions through during state executive council meetings.

All were a part of the state executive council line-up following Election 2008.

Jamaluddin and Mohd Osman had claimed in earlier interviews that their anger with Ngeh and Nga had been one of their primary reasons for abandoning Pakatan Rakyat (PR), a move which had caused the downfall of the Perak PR government in February 2009.

Besides them, former DAP assemblyman Datuk Hee Yit Foong had done the same and had also complained that the cousins had sidelined her when they refused to offer her a spot on the state executive council line-up.

“Firstly, both Jamaluddin and Mohd Osman never spoke out in our meetings. We made hundreds of decisions and only on one or two issues they spoke out and we were in agreement with their arguments.

“We were very professional and (former Perak Mentri Besar Datuk Seri Mohammad) Nizar (Jamaluddin) was very good. We would always go one round and ask everyone for their opinions... it was a perfect power-sharing formula and never before was it ever this democratic in the government,” Ngeh said.

On Hee’s case, Ngeh claimed that he had been very fair to have offered her the post of deputy Speaker in the state assembly.

“Her qualification was only up to Form Five and not that I am saying it’s a bad thing or I am looking down on her. Then, she is also a polio victim and she often complains about travelling. To be an exco member, you have to travel.

“So I thought that the perfect position to give her was the deputy Speaker’s post,” he reasoned.

Ngeh also denied that he had manipulated the votes on Sunday, pointing out that it was close to impossible for him to have forced such a large number of delegates to vote for him.

“We have 175 branches and over 1,200 delegates. It is impossible for me to control the minds of all the voters to choose me. In fact, one-third of them did not vote me and this shows there is freedom to exercise the right not to vote for me.

“How could I be dictatorial just because people voted for me? I do not have a gun to threaten them, I do not have anything to entice or seduce them to my side. But if the people, by my track record, want to vote for me, if they think I am popular, then what is wrong with having a huge majority?” he said.

During Sunday’s polls, the Ngeh-Nga cousins made a near-clean sweep of the 15 posts on the Perak DAP state leadership committee and sailed to an easy victory.

While the duo had polled the top two highest number of votes, their arch-rival in an opposing camp led by former state deputy chairman M. Kulasegaran failed to even make it onto the team.

Kulasegaran and team members like Thomas Su Keong Siong, Keong Meng Sing, Cheong Chee Khing, Seah Leong Peng and Frankie Wong failed to secure a spot on the state committee.

Only one person in his camp scraped through in last place — Jalong assemblyman Leong Mee Meng.

The results were a resounding slap in the face for Kulasegaran, the Ipoh Barat MP, who for months had been attacking the cousins, accusing them of being difficult to work with and too top-down in their leadership style.

The leadership crisis flared last month when an angry Kulasegaran threatened to quit his state posts in the party following an unresolved dispute with the Ngeh-Nga cousins during a special meeting in Ipoh.

Although the leader was finally convinced to stay, tension between the two warring factions continued to rise and Sunday’s polls were a crucial stepping stone for Kulasegaran and his team to topple the cousins in Perak.

Despite their failure, the cousins and the newly-elected team of state committee members decided to co-opt Kulasegaran back into the state leadership as vice-chairman.

But Kulasegaran has yet to decide on the offer.

He has instead charged that there were irregularities during Sunday’s polls, claiming that there were 50 questionable branches represented by 350 delegates who were allowed to vote in the convention.

Ngeh however refuted this, pointing out that the state leadership did not have a hand in conducting the polls.

“Let us just move forward. The delegates have spoken. And I would like to clarify that everything was organised by the central executive committee. All our agents were from out of state.

“The qualification of branches was decided by our party headquarters and the Registrar of Societies so I think we should no longer question that. Everything was done professionally... let us move ahead and plan for the future,” he said.

Perak DAP accept’s Kula’s decision, will not ‘force’ him

POH, Nov 18 — The Perak DAP leadership has accepted M.Kulasegaran’s decision to reject its offer to be vice-chairman and will not “force” the leader to change his mind.
State chairman Datuk Ngeh Koo Ham told The Malaysian Insider this evening that the party would respect his former deputy’s decision but still hoped to work closely with him.

“We still wanted him to work with us in the state committee, which was why we invited him onboard.

“However, if he has rejected the offer, we cannot force him to change his mind,” he said when contacted.

Ngeh added that the party still considered Kulasegaran as invaluable to Perak DAP due to his seniority and political experience.

“We still hope to work with him in the future, in his capacity as an experienced and capable politician,” he said.

Ngeh would not field questions on whether Kulasegaran’s decision was a direct snub of his leadership, expressing hope that the issue would not be played up in the media.

“I think it is best we lay it to rest, there is no need to comment on these presumptions. Kulasegaran has the right to make his decision and we respect it,” he said.

In a media statement today, Kulasegaran announced that he would not accept the party’s offer to be vice-chairman, citing the present circumstances in Perak DAP as his primary reason.

“After having weighed all opinions and taking into consideration the present political development and circumstances within Perak DAP, I have decided to decline the cooption offer from the state committee as a state committee member and as state vice chairman,” he said.

The leader had suffered a major defeat during last Sunday’s party polls when his entire team of supporters were wiped out from the state leadership.

Kulasegaran himself, formerly a deputy chairman in Perak DAP, had failed to secure a spot in one of the 15 state committee posts up for grabs.

The polls results were vastly different from the party’s previous elections in 2008 when Kulasegaran emerged top and polled the highest number of votes, above both his archrivals in the party, Ngeh and his cousin Nga Kor Ming.

This Sunday, it was both Ngeh and Nga who polled the top two highest votes and those said to be on their team sailed to an easy victory, snapping up 14 of the 15 state committee posts.

The duo was later reappointed to their original posts with Ngeh as chairman and Nga as the party secretary.

Only one member of Kulasegaran’s team made it into the team – Jalong assemblyman Leong Mee Meng – but even then, she only scraped through at the last 15th spot.

Despite being the former state treasurer, Leong was not given a post in the committee.

Others like incumbent state committee members Thomas Su Keong Siong, Seah Leong Peng, Keong Meng Sing and Cheong Chee Khing, as well as newcomer Frankie Wong, all known Kulasegaran supporters, failed to make the cut.

Despite this, the newly-elected committee agreed unanimously to co-opt Kulasegaran back into the team as vice-chairman, along with former vice-chairman A. Sivanesan and three others.

The party’s constitution provides for the co-option of five state committee members, to be handpicked by the newly elected team.

Tomorrow, Sivanesan, a close ally to both warring factions, will announce his decision in a press conference at 11am on whether to accept the vice-chairman’s post.

Earlier, the Sungkai assemblyman had told The Malaysian Insider that he was uncomfortable with the idea of entering the state committee through the “back door”, pointing out that he had lost in the polls and fully respected the decision of the delegates.

Today, he said that before making his decision, he would take into account several factors including the issue of party unity and feedback from his supporters and party loyalists.

“I have been receiving many SMSes from leaders and supporters so I will take everything into account. But whatever it is, the party’s interest must come first,” he said.

When asked if he would likely accept the post, Sivanesan declined to comment but added, “I will say this much – I will not let down the people and the party.”

1. Words of Appreciation

The last two years have been an exciting and yet challenging times for DAP Perak. Our membership has grown and increased significantly. We have now about 20,000 in our membership list. We have branches in all the 24 Parliamentary Constituencies in Perak. After the undemocratic grab of power by BN on 6/2/2009, we had to face numerous challenges including the use of force by the police and facing a judiciary that in the words of retired Court of Appeal Judge, Dato’ NH Chan ‘has on many occasions decided cases against the plain provisions of the law.’

I would like to thank the DAP National Leadership, the DAP Perak State Committee, elected representative of PR, members of PR and the public for their support. Not to forget the legal team led by Perak legal bureau chief, Sdr Nga Hock Cheh who has rendered excellent legal service to DAP and the PR with regard to the numerous legal cases on a pro bono basis.

2. Comparison between BN and PR rule of Perak.

Last year at our 15th Annual State Convention, I said ‘The Auditor General has confirmed that the Pakatan Rakyat State Government of Perak has caused improvement to each and every department and agency of the Perak State during its 11 months’ rule. The PR Government has succeeded in making historic achievements during this short period. It is without a doubt that PR is the hope of the people and it has brought the changes the people had voted for on 8/3/2008.”

The PR State Government has increased State Revenue by more than RM100 million from RM538,761,178 in 2007 to RM639,425,143 in 2008 despite not having increased any tax whatsoever on the rakyat and despite the PR State Government having reduced all land conversion premium and quit rent for not profit organizations to RM1,000 and RM40-00 respectively. The PR State Government increased revenue through hard work, open tender system and zero tolerance for corruption.

In the recently released 2009 report, the Auditor General reported that under the BN Perak State Government, the Consolidated Fund for Perak State has dropped from RM774.57 million to RM689.25 million. A drop of RM85.32 million.

The BN Perak Government which grab power undemocratically also show arrogance by refusing to be accountable to the people for what they do. They have refused to answer why lease renewal for Chinese New Villages residential houses is only 60 years when they have promised 99 years lease. They have refused to disclose the lists of lands approved after their power grab on 9/2/2009. I believe that the reason why the BN Perak State Government does not dare to reply or disclose the information requested is because what they have done will not be acceptable to the people of Perak.

BN State Government is also not able to defend its policies because Dato’ Seri Zambry Bin Abdul Kadir, the BN MB for Perak does not dare to authorize Dato’ Dr Mah Hang Soon to debate with me on BN and PR Perak State Government policies in the debate that was planned at the Kwangtung Association Hall, Taiping on 1/11/2010. Dato’ Dr Mah who was the one who challenged me to the debate chicken out and failed to turn up for the debate.

PR State Government has proven to be a better government and the people are hoping that we will come back to manage the State in the next general election. Let all members unite and continue to work together to ensure victory in the next general elections.

3. Democracy

Malaysia is a democratic country and we elect our leaders through democratic means. We condemned BN for the undemocratic grab of power of the Perak State Government on 6/2/2009. We know that a healthy democracy will help a nation grow. Myanmar (Burma) is a clear example of a rich nation that became poor because her leaders refused to allow a healthy democracy. Similar, DAP is a democratic party. As DAP members, let us nurture the democratic virtues in us so that it can become part of our culture. The purpose of a democratic election is to choose leaders to serve for a term specified. Those elected by members are to lead with service also in mind. Those who do not succeed in an election are still part of the team to work together with the leaders that have been chosen.

Members and the public must not always take an election contest as factional when differing views are expressed during the run up to an election. The expression of different views is part and parcel of a healthy democratic process. I regret to note however, that some media tend to sensationalise the run up to an election and I hope members will not be trapped into it.

Let the delegates expressed their democratic choice to elect the DAP Perak leaders for the next 2 years. Just as a Prime Minister is a prime minister for the people of the whole nation, those elected to position must act and carry out their duties as leaders for the whole membership of DAP Perak.

Dato’ Seri Zambry Bin Abdul Kadir, BN Menteri Besar for Perak confirms that Dato’ Mah Hang Soon is not authorized to represent BN Perak Government to debate with Dato’ Ngeh Koo Ham. It also confirms the fact that Dato’ Mah has no say in the BN Perak State Government.

Dato’ Seri Zambry Bin Abdul Kadir, BN Menteri Besar for Perak has confirmed in his statement to the media that the debate between Dato’ Mah Hang Soon and me does not concern him at all implying that Dato’ Mah does not represent the BN State Government in the debate.

His statement confirms my early assertion that Dato’ Mah Hang Soon does not have any say over Perak BN policies and does not have the authority to represent the Perak BN Government.

Dato’ Mah Hang Soon must apologise to the public for giving the impression that he can represent the BN Perak Government to debate with Perak PR.

I have wanted to debate with him the policies of BN and PR that have been implemented and also the proposed programs that BN and PR will be carrying out for the people of Perak

The people are not interested in what Dato’ Mah Hang Soon or I have to say. They would like to see how the policies of BN and PR will benefit them.

Dato’ Mah is now trying again to find the an excuse to avoid the debate. He is now saying that the venue, time and moderator appointed for the 1st November debate are not suitable.

I would like to remind Dato’ Mah that when he put forth his challenge he had stated that he was ready to debate anytime anywhere. PR Perak accepted the challenge and has authorized YB Nga Kor Ming to take up the challenge and fixed 8.00 pm 1st November 2010 for the debate at Kwantung Association Hall at Taiping with NTV 7 Miss Lee Siad Huey as the moderator.

Dato’ Mah Hang Soon then give an excuse that he will only debate with me and not YB Nga Kor Ming. He had never objected to the time, venue or the moderator.

I will wait for Dato’ Mah at time and venue that has been fixed and hope he with get the mandate from BN Perak State Government to debate with me.

Dato’ Ngeh Koo Ham accepts the challenge by Dato’ Mah Hang Soon to debate on the policies of Pakatan Rakyat and the BN Perak Government. Mah Hang Soon must come with the mandate from the BN Perak State Government as he has no say in the BN Perak State Government.

Dato’ Mah Hang Soon, a member of the BN Perak State Government Executive Councillor has recently thrown a challenge to the Pakatan Rakyat Perak to debate on the policies implemented by Pakatan Rakyat during its 11 months’ reign in Perak before the power grab by BN on 6/2/2009.

Dato’ Mah asserts that the policies of BN are better than PR which the latter disputes.

PR Perak has authorized one of its then PR Perak Government Executive Councillor, YB Nga Kor Ming to represent PR to debate with Dato’ Mah Hang Soon. Dato’ Mah Hang Soon however, chicken out giving the excuse that he will only debate with me. I did not accept then because Dato’ Mah Hang Soon like many other Executive Councillors and Ministers of MCA does not have a say over the policies of BN which are dominated by UMNO and therefore, they cannot represent BN.

I had then suggested that since it is a debate over the policies of BN and PR State Governments, Dato’ Seri Zambry Bin Abdul Kadir as BN Menteri Besar should take on Dato’ Seri Nizar Bin Jamaluddin the PR Menteri Besar in the debate. My suggestion has not been taken up by BN as I sincerely believe that Dato’ Seri Zambry does not dare to take up the challenge because BN policies pale in comparison with the PR policies.

In order not to give an impression that the PR Government cannot defend its policies, I hereby declare that I will take on Dato’ Mah Hang Soon to debate on the policies of PR and BN Governments of Perak. I would however, like him to get the mandate from the BN Government of Perak that he represents the BN Government of Perak. I will await the announcement from Dato’ Seri Zambry that his government endorsed Dato’ Mah as his government’s representative. The reason why I insist that Dato’ Mah must get the endorsement from BN Perak Government is because it has been proven that he has no say in the BN Perak Government.

When PR Government approved the freehold titles for Kg Tersunsun and New Villages, Dato’ Mah had asked that the premium discount should be 90% instead of the 80% (of the enhanced value of the property) given by the PR Government. Now, that he is in government he cannot influence the BN Government to give the 90% discount proposed by him. He could not even get the BN Government to continue approving freehold title to the residents of Kg Tersusun and New Village.

I do not want Dato’ Mah to come to the debate delivery the policies of BN which are in fact not that of BN.

I am awaiting to meet Dato’ Mah Hang Soon at Kwantung Association, Taiping at 8.00 pm, 1st November 2010 (Monday).

BN Perak Menteri Besar, Dato’ Zambry and BN must not divert people’s attention from their involvement in transferring voters from one constituency to another.

Dato’ Seri Mohd Nizar Bin Jamaluddin and I have raised our concern that BN is probably behind the transfer of voters who are supporters of PAS/PR from the Pasir Panjang Constituency (Nizar’s constituency) to my constituency of Sitiawan. This is to undermine Dato’s Seri Nizar’ success in the coming 13th General Election in his constituency when he won with 4,474 majority votes in 2008 (11,994 v. 7,520) while allowing DAP to continue to win the Sitiawan Seat. This is because the BN feels is unlikely to be reversed the result of the Sitiawan seat which DAP won by 8529 votes in 2008 (12,381 v. 3852). We have also raised the issue of BN behind removing PAS/PR supporters from the Pengkalan Baharu seat where BN won the seat by only 14 votes.

The media has on 16/10/2010 quoted Dato’ Seri Zambry, the BN Menteri Besar of Perak as saying that Dato’ Seri Nizar and I are probably behind the transfer of voters from Ipoh Timur, Ipoh Barat and Batu Gajah to Sungai Rapat (Dato’ Hamidah’s Constituency).

Dato Seri Nizar and I would like to categorically deny that we are involved in the shifting of voters as alleged by Dato’s Seri Zambry. I have also checked the DAP representatives of Ipoh Timur, Ipoh Barat and Batu Gajah and they are also not involved in the shifting of voters.

I call on Dato’s Zambry to answer specifically if BN is involved in the shifting of voters in the Perak as many have reported to us that BN is involved and will play dirty in this coming General Election. Zambry must not divert the people’s attention from their wrong doings.

Dato’ Seri Zambry and Dato’ Hamidah are involved in a show play (sandiwara). I have news that Dato’ Hamidah is no longer popular with the voters of Sg Rapat and is finding an excuse to move out and contest in Hulu Kinta. Dato Zambry is trying to help her. I understand that the present elected representative of Ulu Kinta (Dato Rosnah) is very upset by this move and there is an upheaval in UMNO. I hope Zambry and Hamidah will clarify the happenings in UMNO rather than shifting the people’s attention to other people.

Agreement has been reached with M Kulasegaran to settle all differences through internal discussion. Our differences not because to seek position, glory or benefit but differences in opinion which occur in any organisation

I am happy to note that this afternoon I have reached an agreement with Sdr M Kulasegaran to settle all differences through internal discussion.

I would like to emphasise that our differences was not because we were seeking personal position, glory or benefit as some have tried to imply when our differences were exposed in the media.

Sdr M Kulasegaran and I have joined the DAP for more than 20 years ago at a time when joining the DAP means only sacrifice and risked being arrested (just after the 1987 Operation Lallang). We joined out of a duty to our nation and a call to contribute to our society.

I would like the public to realise that in any organisation be it in a Parents Teachers Association, a School Board, Chamber of Commerce, a committee of a religious organisation or a non-governmental organisation, there will be differences in opinion as they are made up of individuals. All the more, in a political party where more contentious matters will have to be dealt with.

Very often a decision made will inevitably make some unhappy. For example, when there are three qualified potential candidates for a constituency, only one candidate can be selected to contest on behalf of the political party. When a candidate is selected the other two will probably be unhappy. The public must realise that some unhappiness will be unavoidable in certain political decisions.

Similarly in the democratic system which we all subscribed to, there will be a winner and a loser in a contest.

What is important is that the party chose a candidate base on his merits and suitability. Similarly, leaders in a democratic process is elected to carry out the work that he has been elected to perform. Those who lost are also to help those elected to ensure the tasks ahead are successfully carried out.

Politicians very often have to make a decision in a non-ideal circumstances but the people will judge us with an ideal mind.

I hope the public will not see any differences in opinion as a split, a fractional or factional politicking.

Deeply regret that media will give coverage to a poison pen letter which was obviously false and a piece of rubbish.

I refer to the media coverage concerning a poison letter which has been circulating even before 1/10/2010. I deeply regret that the media should give coverage to such a piece of rubbish.

The letter has no author, no date, no address or contact number and its contents obviously false.

It was addressed to 19 DAP State elected representatives and 6 DAP MPs in the Perak State. (Note: The DAP has only 18 State elected representatives in the State of Perak).

It alleges that all the 6 MPs and 19 State elected representatives were given timber concessions and each of them were paid RM500,000-00 for each of timber concession. No one in his right mind would ever believe that YB Lim Kit Siang, myself, YB M. Kula, YB Nga Kor Ming, YB Fong Po Kuan and YB M. Manogaran and all the other State Assemblymen/women of the DAP would be involved in such a scandal.

If anyone has any evidence of any corrupt practice, against any DAP elected representative, he can easily sell it to UMNO/BN for a million ringgit each. The evidence will ensure that DAP/PR will not get the trust of the people and therefore, the mandate to lead the State in the next General Election.

The records of PR’s administration are in the hands of the BN Perak Government and BN has taken control the Perak State since 6/2/2009. If there is evidence of corruption, they would have exposed it long time ago. The police and the MACC would have been after us a long time ago. Imagine how the MACC went after PR leaders in the Teoh Beng Hock case when the alleged (which is not true) misuse of fund was only about RM2,400.00.

On the contrary, the Auditor General’s office which is a department of the Federal Government has given the PR Perak Government an unprecedented 4 Star excellent performance rating for PR’s short administration of Perak.

I believe the poison letter is not an inside job as speculated by some because it implicates all MPs and State Representatives of the Perak DAP. It was circulated before the outburst of Sdr M. Kulasegaran on the night of 1st October, 2010 when he announced his intention to leave the Perak DAP.

I believe, just like the demonstration by a group of protestors ( who claimed to be DAP members but are not ) in front of DAP Perak on 6/10/2010, it is the work of BN or its supporter. SATU LAGI PROJEK BN.

At around 11.00am this morning a group of about 20 mainly Indian youths demonstrated in front of the DAP Perak headquarters. They claimed to be DAP members from the Buntong branches and members of the PR Youths in Perak.

I have now verified from Buntong DAP branches and our national membership record that those who participated in the demonstration are not DAP members.

We suspect BN is behind the demonstration as the former Ipoh Barat PKR division chief, Fauzi Muda was seen among the group. Can BN owns up?

Speech by Dato’ Ngeh Koo Ham, DAP Perak Chairman at the DAP Taman Kanthan Jaya dinner last night (Sunday 3rd October 2010) at Kwan Ti Meow hall (Temple hall), Perak.

Forgive us if we have been less than perfect in handling DAP Perak problems. DAP Perak calls on the public to allow it to resolve its problems internally and calls on the people to continue to support the DAP for what it stands for and for its proven track record.

Today almost all the newpapers give headline coverage with regard to the intended resignation of Sdr M. Kulasegaran from DAP Perak.

Thank you to the many who have expressed their concern for the unity and the solidarity of DAP Perak. As Chairman I will be the first to be concerned that they are maintained.

After M. Kula informed the media concerning his intended resignation, many unfair articles have been written and hurtful comments made against me and my cousin, Nga Kor Ming. We became the target of hate and are exposed to the attacks of our enemies. For the above reasons, I have earlier expressed my regret that M. Kula should expose internal matters to the media.

I would like to have may side of the story told but I would be committing the same error. I will be exposing my comrades and the party to the attacks of the enemy. A soldier will keep a secret to safeguard a nation and risked being shot. I will willingly suffer the injustice of being denied the right to reply and be subjected to hurtful attacks that have been assailed against me than to put my party in jeopardy and cause the mission of the people to be derailed.

The people’s mission is to have a change of government in the coming 13th General Election to save the nation from bankruptcy and destruction.

Just like any organisation be it a School Board, Parents Teachers Association, a church committee, a temple committee or a Non Government Organisation, there are bound to be differences because they are made up of individuals. Whatever differences, they must be resolved internally lest it brings negative impact and image to the organization. I believe whatever differences, M. Kula has with me or with others, they can be resolved internally. I asked that you do not hate M. Kula for what he has transpired. I asked that you do not hate me or my cousin, Nga Kor Ming after hearing one side of the story. You may have judged us wrongly and unfairly. Please support each and every leader of the DAP. Allow us to settle our differences internally just like you would with other organizations.

You must continue to support the DAP for what it stands for and for its proven track record. Each and every support is needed to accomplish our coming mission. I hope this episode will not in any way erode your confidence in the DAP and PR. Forgive us if we have acted less that perfect in the abovesaid episode.

Menteri Besar Perak (BN) Should Explain Why The Sudden Drop Of RM247.5 Million In State Reserve In Less Than 2 Mths Or He Lied To The Perak State Ass.

BN Perak Menteri Besar Dato’ Seri Zambry Bin Abdul Kadir, the court appointed Menteri Besar must explain why the sudden drop of RM247.5 Million in State reserve in less than 2 months or did he lied to the Perak State Assembly?

On 3/8/2010, Dato’ Seri Zambry Bin Abdul Kadir stated in the Perak State Assembly that the State has RM847.5 Million (according to book value) in reserve or RM928.36 Million if based on current market value.

The New Sunday Times in its 26/9/2010 edition quoted the Perak State current reserve stands only at RM600 Millions. Why a sudden drop of RM247.5 Millions in less than 2 months?

At the 3/8/2010 State Assembly sitting, Dato’ Zamry boasted an increase in revenue of RM117.26 Milliion for the period of January to July 2010. What has happened to this additional amount? The state reserve should have increased in view of this additional income.

Dato’ Zambry has nothing to boast concerning this additional RM117.26 million as I was given to understand this amount comes mainly from land premium payments. I was not given the opportunity to verify this from the State Government as Dato’ Seri Zambry has insisted that the State Assembly can only sit for one day so that the elected representatives do not have the opportunity to question the state government on numerous issues. Income from land premiums only mean that the BN government has been approving many pieces of land to cronies at prices much below the market value. The increase in income was not due to good governance, competence, thriftiness or creation of wealth through effective development programmes.

The New Sunday Times report further quoted the State Financial Officer Datuk Jamalludin Al Amini Ahmad as saying that the State Treasury is recommending a RM50.0 Million deficit budget for 2011. Why further deficit when there is so much additional income?

Under the Pakatan Rakyat 10 months’ rule, we increased the revenue by RM103 Million or about 17% of the state revenue without increasing any form of taxes despite giving water, study grants and other assistance to the poor. We also collected only nominal premium and quit rent for conversion of agricultural land to building category for non profit organizations like the schools, religious organization and dialysis centres which amount to millions of ringgit.

Dato’ Zambry and the BN State Government have a duty to answer the people with regard to the abovesaid matters.

The people demands transparency and accountability from BN Perak Government but many people reminded me not to expect too much from robbers.

霹雳州人民在哀悼。不要强迫我们庆祝。如果强迫我们悬挂国旗和州旗，那我们是否可以升半旗呢？

怡保市长拿督罗西迪强制商家必须在霹雳州苏丹华诞和国庆日悬挂国旗和州旗，不然商家将被罚款250令吉及被夺回营业执照。

霹雳州人民在哀悼中，因为他们没有机会投选所要的政府，这犹如马来亚当时被统治的情况。民主已在霹雳州死亡。当州议会进行时，许多警员包围及控制着霹雳州议会大厦。在国政的指示下，合法的州议会议长，Mr. V.Sivakumar被警员们强迫拉出州议会。警方在按照国政的指示下行事，也可以违反法律。霹雳州也因此成为了警察州。州议会已不再是商讨与辩论州事的地方。各代表也没有机会自由地发表。周内年度预算案只在短短的20分钟内被通过。与此同时，州议会也在一天内结束。这情况使到霹雳州人民，同时也包括马来西亚人民感觉到8月31日的国家独立日不再有意义了。

大家应该允许霹雳州人民在8月31日哀悼，也认同他们在当天穿上黑衣或悬挂黑色旗，因这可能减轻霹雳州人民在国政的压迫下所受到的不公平待遇。

在这强迫人民悬挂国旗和州旗的情况下，犹如当时日本统治马来亚，一样的强迫人民悬挂日本旗和向日本政府宣誓效忠。

如果国政政府和怡保市长坚持这条例，请问商家们是否能得到允许升半旗呢？

Perakians are mourning. Do not force us to celebrate. If forced to fly the flag, can we fly half mast?

I refer to the statement by the Mayor of Ipoh, Datuk Roshidi Hashim that shops that do not fly the national flag on National (Independence) Day, or the state flag on the Sultan’s birthday will risk their licences withdrawn.

Perakians are mourning as they can no longer choose their own government just like colonial days. Democracy is dead in Perak. Hundreds of police surround and take hold of the Perak State Assembly building whenever the Assembly sits. The legitimate speaker, Mr.V.Sivakumar was forcibly removed by the police from the State Assembly on the bidding of BN. The police broke laws with impunity because they carry out their actions according to BN’s instructions. Perak in virtually a police state. State Assembly is no longer a place to debate and discuss the affairs of the state. Elected representatives are no longer allowed to speak freely. Annual Budget is approved within 20 minutes and State Assembly is over within a day. For Perakian and Malaysians who symphatise with us, there is nothing to celebrate on this 31st August our national independence day.

Allow Perakians to mourn for this may be soothing to their souls. Allow them to wear black coloured shirts or even fly black coloured flags on 31st August, if that will help to alleviate the injustice that they are subjected to.

Has the Mayor of Ipoh been directed by BN Government of Perak to enforce the above said ruling? It sounds like imperial masters of the past forcing patriotism on the conquered subjects. It is like the Japanese who conquered the then Malaya and using force on the people of Malaya to host the Japanese flag and swear allegiance to the Imperial Japanese Government.

If the BN government and the Mayor of Ipoh insist that shop owners must fly the flags, may I ask if they are allowed to fly half mast?

Dato’ R. Ganesan, the chairperson of the Perak State Assembly sitting on 3/8/2010 acted against the fundamental purpose of a legislative assembly and breached the legislative assembly convention when he ordered Dato’ Seri Nizar Bin Jamaluddin out of the State Assembly. Dato’ Seri Zambry, BN Perak Menteri Besar does not want the State Assembly to function properly.

The media were not aware of the events in the Perak State Assembly before Dato’ Seri Nizar Bin Jamaluddin, as opposition leader stood up to speak during the 3/8/2010 sitting. This is because they were not allowed into the State Assembly (except the pro BN media) and were placed in a glass enclosed area where they cannot hear the proceedings unless BN appointed technicians turn on the microphone in the State Assembly.

Dato’ R. Ganesan had ruled that Dato’ Seri Nizar as opposition leader be given 15 minutes to speak and the other elected representatives be given only 10 minutes to speak. He also ruled that the sitting will only be for one day. This has sparked protest and objection from Dato’ Seri Nizar and PR elected representatives as this ruling make a mockery of the legislative assembly. The microphones were switch off so that the media cannot hear the protests and the hansard will not record the request by the PR elected representatives to have at least 4 to 5 days’ sitting.

The fundamental purpose of a legislative assembly is to allow elected representatives total freedom to speak before any enactment or bill is passed. The elected representatives are also expected to bring out all issues that affect their constituents. This is the place where elected representatives are expected to speak their minds. Laws have even been passed to protect elected representatives from being sued so that they are free to speak. Dato’ Ganesan’s rulings go against the fundamental purpose of the legislative assembly.

By convention, the Perak State Assembly does not limit the time an opposition leader can address the house. The only limitation the State Assembly imposed is that the speech of the elected representatives must be relevant and relate to the State of Perak.

In 2004 when I was the opposition leader, Dato’ Seri DiRaja Tajol Rosli of Barisan Nasional who was then the Perak Menteri Besar allowed me to speak as long as I like and my speech normally takes about 3 hours to cover the various issues affecting the people and the State of Perak.

In 2008, when Pakatan Rakyat was in government with Dato’ Seri Nizar Bin Jamaluddin as Menteri Besar we also did not limit the time Dato’ Seri Tajol Rosli who was then the opposition leader to speak and he took about 2 ½ hours to deliver his speech.

It is the duty of Dato’ Seri Nizar and Pakatan Rakyat elected representatives to protest and object to the ruling by Dato’ R. Ganesan to limit speeches to 10-15 minutes which is ridiculous.

The Pakatan Rakyat representatives would have failed in their duty if they allow this ruling to stand as the people who elected them expect them to discuss and debate all issues affecting the people.

Pakatan Rakyat elected representatives have submitted more than 200 questions for the BN Government to answer. The 1 ½ hours allocated for Question and Answer session per day of sitting normally see only about 10 questions being answered. It is the intention of the BN Government not to answer the questions submitted by PR elected representatives.

The BN Menteri Besar, Dato’ Seri Zambry and his Exco must be willing to be questioned like the Prime Minister and his cabinet in Parliament. If they do not want to be accountable to the people, then they should resign honourably. They cannot be allowed to take high pay and enjoy all the perks which are paid by the people and yet not be accountable to the people.

The 3/8/2010 sitting clearly show that Dato’ Seri Zambry, the Menteri Besar together with his Exco who were rejected by the people but gain power through despicable means and assisted by the court do not actually want the State Assembly to function.

The majority of the people who do not trust Dato’ Seri Zambry and his Exco have been proven right as Zambry and his Exco do not want an open debate which will expose them.

To the small group of the people who have asked us to give BN a chance to operate, the events on 3/8/2010 sitting and the earlier sittings clearly show that BN Perak does not want the Perak State Assembly to operate.

Perak Menteri Besar, Dato’ Seri Zambry and the Perak State Secretary, Dato’ Dr Abdul Rahman must explain who instructed the State Assembly doors be pad locked and who gave instructions to prohibit laptop computers from being brought into the Perak State Assembly when Dato’ Ganesan a/l Retanam who chaired the State Assembly yesterday has stated his stand otherwise

Dato’ Ganesan A/L Retanam who chaired the Perak State Assembly yesterday upon my query ruled that laptop computers can be brought into the State Assembly and he also ordered that the doors on the opposition side that were pad locked be unlocked.

Prior to the sitting yesterday, the Perak State elected representatives had received a notice from Rumaizi Bin Baharin @ Md Daud, the secretary to the State Assembly that laptop computers and video cameras cannot be brought into the State Assembly. Rumaizi Bin Baharin @ Md Daud unfortunately is a civil servant employed by the state government seconded to the job.

I have queried Dato’ Ganesan why when it has been the policy of the State Assembly to encourage elected representative to bring laptop computers to the State Assembly have now been prohibited from doing so. In fact the State Assembly has in 2004 and 2008 budgeted and gave each elected representative a new laptop computer to enable State Assemblyman/ women quick access to information. The State Assembly has wireless internet connection for easy access to internet information. Dato’ Ganesan replied that laptop computers are allowed in the house.

I also queried why when the letter from Rumazi stated that video cameras are not allowed, BN has position people to openly video shoot the whole proceedings to which Dato’ Ganesan has no answer. When I complained that the doors of the State Assembly on the opposition side are pad locked, Dato’ Ganesan ordered the doors to be unlocked.

In the last sitting the doors on the opposition side were also pad locked and the opposition elected representatives have no choice but to walk across the Assembly hall to the other side to exit from the House. Some pro BN media have labeled us as rude and uncivilized for walking across the hall. I believe it is BN’s strategy to use this method to produce materials to paint PR elected representatives in a bad light.

Media representatives (except those appointed by BN) have no access to the Stated Assembly. They were quarantined in an glass ‘aquarium’ where they can hear only what BN wants them to hear i.e the microphone is swith on or off at the dictate of BN employed technicians.

Unless Dato’ Ganesan dare to cite Dato’ Seri Zambry and the State Secretary, Dato’ Dr Abdul Rahman for contempt of the august house, he should step down immediately rather be humiliated like a cow with its nose hooked and led by Zambry and Abdul Rahman.

Zambry and Abdul Rahman must answer to the public for the contempt they showed to the Perak State Assembly and putting it into disrepute.

Pakatan Rakyat 10 months’ rule saw Perak revenue touch historic high with additional RM103 Million Ringgit. 10 months’ Barisan Nasional rule see Perak facing highest deficit in history with RM104 Million in deficit.Request by BN Perak Government for an additional RM80.0 Million proves PR governs the Perak State better that BN.

Perak Barisan Nasional (BN) government had presented a deficit budget of RM39,998,870for 2008. It had also presented deficit budgets for many years prior to 2008.

When Pakatan Rakyat (PR) took over the administration of the Perak Government, it collected an additional revenue of RM103 million without increasing any form of tax or charges on the people. Therefore, there was a surplus amount of about RM63 million for the year 2008.

Pakatan Rakyat when presenting the 2009 budget at the end of 2008, has no knowledge yet that it will be collecting an additional sum of RM103 million for 2008. So, PR being prudent, presented a budget with a reduced deficit of RM25 million.

In view of the increased in revenue in 2008, PR believes that had it been given the opportunity to continue to administer Perak it would also have been a surplus for the year 2009.

Unfortunately, we see BN undemocratically grabbed power in Perak on 6/2/2009. Perak under BN continued to be a year in deficit for 2009.

BN had again presented a deficit budget for 2010 with a deficit of RM23,890,000. As expected with its corrupt and non transparent administration, BN Perak State administration chalked up additional expenditure. It has now asked the State Assembly sitting on 3-8-2010 to approve another RM80 million for its administration.

In the circumstances, BN Perak State Government is expected to register RM103,890,000in deficit for 2010 which is the highest in the history of Perak.

BN Perak Government is paying and giving benefits to Dato’ Chan Ko Youn, Dato’ Veerasingham, Dato’ Hamdi Bin Abu Bakar for holding posts without a job. Why does the government need to pay Dato’ Chan Ko Youn and Dato’ Veerasingham as state advisors with Exco pay and benefits? Is Dato’ Seri Zambry Bin Abdul Kadir the BN Menteri Besar admitting that he is not competent to government the State or is he just trying to benefit BN candidates who have lost in elections? These are public funds and not his personal money.

BN Perak State Government has announced giving RM50,000 to each MCA division. We believe secretly it is also doing so for UMNO divisions.

Zambry has spent huge amount of State money to put up thousands of posters to promote himself.

Perak BN government also wasted State fund to promote itself by advertising in the media and sending ‘Teachers’ Day’ cards every teacher.

The public demands that BN stop wasting public funds. Public funds are meant for the public and not to promote BN or Zambry.

PR once again calls for open tender of government projects which will save Perak State Government money and also open tender of awarding timber concessions which has proven to bring in huge increase of revenue to the State Government.

I call on the Dato’ Seri Zambry to itemize what the proposed to use the additional RM80 Million for. The people has the right to know the details to avoid it going to dubious projects.

Investments in Perak highest during PR's rule

Investment was the highest in Perak during the reign of Pakatan Rakyat (PR).

The figures released by Malaysian International Trade and Industry (MITI) for the last 10 years from 2000 to 2009 show that the investment in Perak was the highest when PR ruled Perak.

The investment in Perak in 2008 was RM3,130,017,250. This was despite the fact that PR took over power only after March 2008 and the uncertainty that surrounds the first 2 months of the change of Government after more than 50 years of BN rule. It was also despite the fact that the United States of America and Europe were facing economic crisis in 2008.

Investors were having great confidence in PR after just a short period of its administration. I believe investments would have increased further had it not for the undemocratic grab of power by BN on 6-2-2009.

Due to the grab of power by BN, investments drop drastically in Perak by 71.5% to only RM893,872,874 million in 2009.

Prime Minister, Dato’ Seri Najib Bin Tun Razak and Dato’ Seri Zambry Bin Abdul Kadir are to be blamed for dashing to pieces the new hope that PR was bringing to the people of Perak. They killed the economic prosperity that was to follow due to the exemplary rule of Pakatan Rakyat Government which was highly praised by the Auditor General’s office.

Unemployment and low paying jobs continue to dominate the job market in Perak. The people must teach BN leaders a lesson in the coming 13th General Election for putting personal powers and interests above the welfare of the people of Perak.

Perak Pakatan Rakyat elected representatives looking forward to an incident free State Assembly on 3rd August 2010. Hope Perak BN Government will cooperate

The Secretary the State Assembly, Encik Rumaizi Bin Baharin @ Md Daud has called for State Assembly to sit on 3/8/2010.

The Perak Pakatan Rakyat Assemblymen and Assembly women met last night and have expressed the hope that this coming State Assembly sitting will be incident free. We hope that for the sake of the people of Perak, the BN Perak Government will act responsibly by answering questions raised by the elected representatives and allowed debates to be conducted in free and conducive environment.

We call on the Perak BN Government to cease the following which have occurred in the past State Assembly sittings:-

(i) Allowing the police to surround and invade the State Assembly creating a climate of fear and intimidation.

(ii) Refusing to answer the questions raised by the elected representatives base on a flimsy reason that it was forwarded to the Assembly secretariat by V. Sivakumar, the PR recognized legitimate speaker. Nowhere under the rules is this prohibited. Questions can be forwarded through email, courier, pos laju, normal mail, an office boy or any other person. Pakatan Rakyat elected representatives are willing to forward their questions directly to the State Assembly Secretariat this time round just to avoid the people’s questions go unanswered.

(iii) The microphones of the Pakatan Rakyat elected representatives were switch off to prevent them from debating or asking questions.

(iv) Doors to the State Assembly were locked to ensure that Pakatan Rakyat elected representatives use only the route designated which is controlled and under the strict surveillance of the police.

(v) Only BN controlled media are allowed into the State Assembly while other media are locked in a room where the audio sound cannot be heard except for selected messages that the BN Government wants them to hear.

The above said incidences have make a mockery of the democracy in Perak. Perak Pakatan Rakyat had hoped that fresh election can be called to restore full democracy in Perak but BN has refused to do so. Until then, for the sake of the people of Perak, Pakatan Rakyat elected representative will continue to bring up the issues affecting the people by asking questions and debating on the issues affecting them.

The question of who is the legitimate speaker is a legal one. Pakatan Rakyat is of the view that from whatever angle, Dato’ Ganesan cannot be a legitimate speaker and Mr. V. Sivakumar is still the lawful and legitimate speaker.

In order that this coming State Assembly sitting will go on smoothly without its legitimacy being questioned, Mr V. Sivakumar will also issue a notice for the State Assembly to sit on 3/8/2010. Again, in order that this coming sitting will proceed smoothly and for the sake of the people of Perak. Mr V. Sivakumar and the other Pakatan Rakyat elected representatives have also agreed to allow Dato’ Ganesan to chair the meeting albeit not as a speaker (as his legitimacy can only decided by law) so that this session can be conducted in an orderly manner and free of any untoward incidence.

We hope the Perak BN Government will respond positively for the sake of the people of Perak.

Proposed New Insurance Scheme by Bank Negara

1. DAP calls on the Government to consult all stakeholders before implementing the proposed new scheme by Bank Negara Malaysia to cover third party bodily injury and death.

2. DAP calls on the Government to review the limits imposed by the Civil Law (Amendment) Act 1984 on the quantum of damages for personal injury claims which does not reflect the actual loss suffered by the victims or their families.

Bank Negara Malaysia (BNM) has proposed to introduce a new scheme to cover third party bodily injury and death which it hopes to implement in the second half of 2010.

Several DAP MPs had a meeting with representatives from the Bar Council led by its President, Mr Ragunath Kesavan yesterday. Having studied the proposed scheme, DAP MPs are of the view that the proposed scheme has wide implications and ramifications.

The DAP calls on the Government to be transparent on the proposed scheme and allow all stakeholders’ views to be taken before any decision to implement the said scheme is made. A committee where all stakeholders are represented must be formed to study the proposed scheme before the Government makes any decision.

Meanwhile, the DAP calls on the Government to immediately review the limits imposed by the Civil Law (Amendment) 1984 where only a sum of RM10,000-00 is paid for a death purportedly for bereavement and no loss of income is allowed if one has reached the age of 55. It also does not allow a victim to claim for any loss of income though he is highly qualified and has the potential of high earnings if at the time of accident he is not gainfully employed. The limits imposed are grossly unfair and unjust as they do not reflect the actual loss suffered by the victims.

DAP mourns the lost of one of its veteran members Tuan Haji Ibrahim Singgeh who pased away at 7.40pm on Monday (31/5/2010) aged 92 leaving behind a wife, Puan Hajjah Jamilah Bt Sham, 3 sons and 2 daughters. He was buried today (1/6/2010) at the Kg Sekolah Banir Muslim cemetery in Perak. The late Ibrahim Singgeh was the State Assemblyman for Tapah Road (now Air Kuning) in 1969. He was also a former Deputy Secretary of the DAP. Two years ago DAP Perak held a birthday party at the Dewan Merdeka Tapah to celebrate his 90th birthday.The DAP would like to put on record its appreciation for the services rendered by him to the party and the nation. The Party would like to extend its deepest condolence to the bereaved family of the late Tuan Haji Ibrahim Singgeh. He will be greatly missed by all.

BN Using the Police

BN Perak Government successful in using the police to divert attention from its misrule. Call on the police to concentrate on its primary duty of maintaining law and order. The police must also observe law themselves

I am deeply sadden that the media and the people of Perak is focusing this morning on the police investigation against me purportedly for sedition. BN Perak Government has successfully diverted the people’s attention by using the police force. The media and the people should be focusing on the 216 questions raised by the PR elected representatives in the State Assembly which concern the Perak State and the people of Perak. The people of Perak wants to know if the BN Perak Government has approved or intents to approve 14,000 hectare of land to Rahman Hydraulic Tin Bhd for tin prospecting, why timber concessions in the State are not open for tender and the list of persons or companies who were approved land in the last one year since BN grabbed power in the State. There were hosts of other issues that affect the people of Perak which the Perak BN Government must answer.

The primary duty of the police is to maintain law and order. They should be going after criminals but in Perak they have been used by BN to act against Pakatan Rakyat elected representatives. The police instead of answering my demand and the demand of the people that the police stay clear of the Perak State Assembly, now choose to act against me. I will continue with my demand that the police cease to descend in large numbers at the Perak State Assembly or its precincts when the State Assembly sits as it interfered with the independence of the State Assembly. I also question why the Police Force Commission has not commenced its investigation into the conduct of the Perak Police force when so many police reports have been lodge against them? I will continue with my struggle to uphold the democratic institutions of this country to ensure Perak and Malaysia will not become a police state.

This morning I also demand that police must follow the law. The Federal Court in Authony Gomez v Ketua Polis Daerah Kuantan 2MLJ 24 which were also followed in subsequent cases very clearly decided that a person who has any interest in a first information document including a police report is entitled to a copy of the document. Unless a police report is supplied to me I will not be able to give a proper statement to the police as I will not be able to answer in the proper context. I am also demanding this right for the Malaysian public because a person who is called to give a statement or arrested must know why he is called or arrested.

The police have promised me many months ago to get an opinion from the Attorney General’s office but till date has not done so. I call on them to get the legal opinion immediately if they are still of the opinion that the police report cannot be given to me.

Statement By Dato' Ngeh-Policemen in the State Legislative Assembly

Call on the Police Force Commission to investigate into the conduct of the police force in Perak whose overwhelming presence at every sitting of the Perak State Assembly has negate the very notion that the Legislative Assembly must be free from outside interference.

I refer to the media statement issued by the Perak Chief Police Office (CPO), Dato’ Pahlawan Zulkifli Bin Abdullah yesterday that I will be investigated under Section 4(1)(a) Sedition Act, 1948 with regard to the State Assembly sitting on 31/3/2010. This is a clear indication that the police is actively involved politically to side the BN Perak State Government that was not democratically elected. They have deviated from their primary role of maintaining law and order. They are now actively involved in helping BN find fault with the PR leaders.

I call on the Police Force Commission to investigate into the conduct of the police force in Perak whose overwhelming presence at every sitting of the Perak State Assembly has negate the very notion that the Legislative Assembly must be free from outside interference.

Perak is effectually a police State. The police is used to protect and ensure that the BN which has been rejected by the people in the last general election but grabbed power through undemocratic means stays in power. The overwhelming presence of the police during Perak State Assembly sittings negate the idea of a Legislative Assembly that is free from outside interference.

The police is now trying to find fault with me not because they want to uphold the law. The BN is trying to use them to oppressed the opposition. I will not fear intimidation as I have my oath of office to uphold. If the police truly uphold the rule of law they should have the policemen who invaded the State Assembly and forcibly removed V. Sivakumar from his speaker’s seat on 7/5/2009 charged in court. I challenge the CPO to reveal the names of all those policemen who entered the Perak State Assembly. The police have refused to disclose their names thereby hampering the course of justice. Due to the refusal to disclose the names, the Legislative Assembly Speaker V. Sivakumar could not sue them.

The CPO said that the police acted because they followed the instructions of the Speaker. The police followed the instruction of BN and not the Speaker. On 3/3/2009, when V. Sivakumar was recognized by both BN & PR as the legitimate Speaker why did the police ignored his instruction to allow the State Assemblyman and women to convene the sitting of the State Assembly thereby causing the infamous Assembly sitting to be held under a tree? Police have clearly breached Section 124 of the Penal Code when they prevented the elected representatives from performing their duties. Why was no one charged in court? Police takes instruction from Dato Ganesan because he is BN installed.

Police have been violent against V. Sivakumar on 7/5/2009 and 28/10/2009 and other elected representatives on other occasions. We believe they can be violent when instructed. Therefore, there is real fear that they will be violent on 30 & 31/3/2010 when hundreds of them surrounded the State Assembly and occupy the corridors of the State Assembly. The police have permitted many plain clothes strangers into the State Assembly which from past experience could also be members of the police force.

The Pakatan Rakyat elected representatives view the huge presence of the police as an intimidation to overwhelm or overawe them. The State Assembly has always been conducted in an orderly manner with only one Sergeant At Arm in his ceremonial clothes. Even assuming that police presence is needed, 4 or 5 of them will be more than sufficient. In the whole Perak crisis, the elected representatives from both the BN and PR have never used physical force against each other. It was always the police who have acted violently.

I would like to remind the CPO to observe the law and not act on the wishes of BN because he will find himself one day charged in court once he is out of favour with BN or the police force. Dato Seri Anwar Ibrahim and Dato Ramli bin Yusoff are examples that he must always be mindful of.

Press Statement - YB Dato' Ngeh Koo Ham - Call To Revert The Filing Of Returns & The Payment Of Real Property Gains Tax (RGPT)

Call to revert the filing of returns and the payment of Real Property Gains Tax (RPGT) to that practiced in 2007. New procedure unfair cumbersome, burdensome and has caused uncertainty.

Real Property Gains Tax was introduced in 1976 through Real Property Gains Tax Act 1976. RPGT was abolished from 1/4/2007 but was reinstated by the Government from 1st January 2010. From 1/1/2010, the Government imposed 5% tax on gains received from the disposal of a property which was acquired within 5 years.

The new RPGT rules, however, require the Purchaser to forward the returns and 2.0% of the purchase price to the income tax department within 60 days from the date of the Sale and Purchase Agreement failing which an additional 10.0% on this amount will be imposed.

These new rules are unfair, cumbersome, burdensome and has caused uncertainty for the following reasons:-

1. 2.0% of purchase price very often far exceeds the 5.0% RPGT that is imposed.
e.g. If a property acquired at RM1.0 million is sold for RM1.1 million there is a gain of RM100,000-00. A sum of RM22,000-00 will have to be paid to the income tax from the deposit paid within 60 days. The tax payable is however, only RM5,000-00. A sum of RM17,000-00 will have to be claimed back from the income tax department on a later date. From experience, it will take a long long time to claim back money from a government department. This constitute undue enrichment to the Government who does not pay interest on this additional sum paid.

2. The Purchaser or his solicitor is under a duty to forward this 2.0% of the purchase price. This placed an unfair duty and burden on the Purchaser because additional 10.0% penalty will be imposed on this amount if payment is delayed.

3. Those who will not be taxed will also be required to file form.

4. Getting the refund and filing of the unnecessary CKHT 3 form will cause the parties expenses and time. This is unproductive work for both the government servants and the additional staff that the solicitors and tax agents will have to employ.

5. It create uncertainty when a sale falls through. In such an event the deposit paid will be forfeited by the Vendor. The 2.0% purchase price which form part of the deposit was paid by the Purchaser to the income tax department. Will the tax department refund the amount to the Vendor or the Purchaser in the event of a dispute?

6. In the case where a sale is contingent on an event e.g the requirement for the Menteri Besar’s consent, will the 2.0% purchase price still have to be forwarded to the income tax department within the 60 days period? (one income tax officer says the 60 days period operate from the date the Menteri Besar consent is received but it is not stated in the rules. Will the Purchaser be slamned with a 10% increase if another officer interprete otherwise?)

I proposed that we revert back to the practice in 2007 before RPGT was abolished. Both Vendor and Purchaser submit their respective returns within 30 days and RPGT be paid upon the tax department issuing the notice for payment. The estimated RPGT payable be retained by the Purchaser’s solicitors until then. At least the Purchaser is entitled to the interest earned if the tax department delayed in assessing and issuing the notice for payment.

Dato’ Ganesan’s action in inviting the police to take action against YB V.Sivakumar , The Legitimate Speaker of the Perak State Assembly, clearly shows his willingness to destroy the democratic institution in Malaysia. He is not part of the Perak State Assembly and neither is he the Legitimate Speaker. Therefore, he has no qualms about destroying the institutions of the Speaker and the State Assembly.

King Solomon was once asked to decide who is the mother of a child. Two women both claimed to be the mother of the child. King Solomon in his wisdom (then he did not have the benefit of DNA tests) decided that in order to be fair to both the child be cut into two and each woman be given one half. One agreed but the other woman immediately requested the King to spare the child’s life and have the child given to the first woman. The wise King immediately knew who the child’s mother was. A mother will never want to see harm befall his child.

The police report lodged by Dato’ Ganesan on 19/3/2010 inviting the police to take action against YB V. Sivakumar, the Legitimate Speaker of the Perak Assembly, is clearly an action calculated to destroy the democratic institution of the Perak Sate Assembly. Dato’ Ganesan had on 7/5/2009 invited the police force to invade the Perak State Assembly and forcibly removed YB V. Sivakumar from the State Assembly. The harm that was done to this democratic institution of Perak was beyond repair.

Like the woman who is not the mother of the child, Dato’ Ganesan has no qualms about destroying this democratic institution of Perak. He was a reject. The people rejected him during the last General Elections. He is not part of the State Assembly and neither is he the Legitimate Speaker of the Perak State Assembly. His ascension to the Speaker’s seat on 7/5/2009 was done by using the police to forcibly removed YB V. Sivakumar.

In a democratic system, the separation of powers between the judiciary, the legislature the executive have been clearly defined. All matters pertaining to the State Assembly must be dealt with by the Assembly itself. The independence and the sanctity of the legislature must never the sacrified or compromised. What Dato’ Ganesan is doing in to encourage a Police State where might is right.

YB V. Sivakumar has in all his conduct tried to maintain and uphold the independence and the sanctity of the State Assembly. He was never cowed by the threat or force used by BN and the police against him.

All Malaysians must condemn Dato’ Ganesan for his treacherous act against over democratic institutions.

Deputy Education Minister, Dato Dr Wee Ka Siong was wrong to say that I was not in favour of Local Government Elections

Last Night, the Deputy Education Minister, Dato’ Dr Wee Ka Siong during the Editor’s Time Forum Special program televised on NTV 7 at 11.00pm last night (18/3/2010) quoted me as not in favour of Local Government Elections.

I would like to reiterate that I have all along advocate for local government elections. The Deputy Minister was wrong in quoting me as not favouring local government elections.

The Pakatan Rakyat Perak government during its 10 ½ months’ reign had not immediately implemented local government elections as there were differering views as to whether federal laws need to be amended before local government elections can be implemented.

As a government, we wanted to make sure that whatever we do is according to law as we uphold the rule of law. We were awaiting expert legal opinions on the matter when BN undemocratically seized power on 6/2/2009.

Now that the Penang State Government has written to the Election Commission, I hope this legal issue will be settled soon.

Media Statement

Pakatan Rakyat Perak (PR) heeds the people’s call to move forward and hope Perak BN will do the same by allowing the legitimate speaker YB V.Sivakumar to chair the State Assembly sitting on 30/3/2010. PR state Assemblymen/women will disclose to the public questions and issues raised to ensure accountability and transparency on the part of BN.

Yesterday, all 27 Perak PR elected representatives have submitted their question to the secretary of the Perak State Assembly to be answered by the BN Government at the coming assembly sitting on 30/3/1020. The People are angry that BN has refused to dissolve the Perak State Assembly to pave way for a fresh election to allow the people to decide democratically who to lead the state. Many have indicated to us that they will teach the BN a lesson and vindicate PR in the next general election. Meanwhile, the people want us to move forward for the sake of Perak and PR heeds their call.

I call on Dato’ Seri Zambry bin Abdul Kadir the BN Menteri Besar to also heed the people’s call by allowing the legitimate speaker, YB V.Sivakumar to chair the meeting on 30/3/2010 so that the sitting will not be tainted with controversies as Dato’ Ganesan cannot be a valid or legitimate speaker by any account.

Dato’s Ganesan cannot be a valid speaker as he was elected by the BN elected representatives in a chaotic environment and before the session was opened by his Royal Highness the Regent of Perak. Even had he been lawfully elected, which he was not the Perak Constitution would have declared his position vacant as he did not resign from his legal profession within 3 months from his purported election. His ascension to the speaker’s seat was by forcibly removing the legitimate speaker which is unlawful and an offence. If Dato’ Ganesan is accepted as a legitimate speaker, it will set a precedent that the opening of the Assembly sitting by the Sultan or Regent will no longer be necessary.

In order that the rule of law can be observed, I call on Dato’ Seri Zambry to allow YB V.Sivakumar to chair the Perak Assembly on 30/3/2010 so that the questions can be answered by the BN Government and the debates can conducted in an orderly and lawful manner. For the People’s Sake, PR Perak wants to move forward and we hope BN will also heed the wishes of the people of Perak.

In order to ensure accountability and transparency on the part of the Perak BN Government, the PR elected representatives will in this coming 2 weeks disclose to the public the questions and issues raised by them. Perak BN must answered each and every question or issue raised.

As a start I attach herewith the 8 questions submitted by me. An assemblyman/woman is allowed to ask a maximum of 3 questions requiring oral reply and 5 questions requiring written reply.

Call on Datuk Ramly Zahar,i BN Perak Government Exco member to tell the truth with regard to his claim that 60 multi purpose and community halls had their water and electricity supply cut and not blamed them on the Pakatan Rakyat Government. During the Pakatan Rakyat’s reign there was no such problem. Does he has an agenda against Dato’ Seri Zambry Bin Abdul Kadir?

I refer to statement by Datuk Ramly Zahari that 60 multi purpose and community halls in Perak do not have electricity or water supply due to their failure to pay the utility bills in the past 10 months and he attributed in to the fault of the Pakatan Rakyat Government.

I would like to put on record that during the tenure of the Perak Pakatan Rakyat Government from 17/3/2008 till 5/2/2009 there was never a complaint received that water or electricity supply to a multi purpose or community hall will be cut due to the failure to pay the utility bills. This was so during my post Exco meetings with all the relevant departments chaired by me where Tenaga Nasional Berhad (TNB) and Lembaga Air Perak (LAP) were represented and neither did BN as the opposition then raised such an issue.

If the electricity bills were unpaid during the last 10 months, then they were unpaid during BN’s reign as BN has grabbed power for more than 13 months on 6/2/2009.

I know Datuk Ramly Zahari is from an UMNO Perak camp different from that of Dato’ Seri Zambry Bin Abdul Kadir. Is he trying to embarrass Dato’ Seri Zambry, the court appointed Menteri Besar of Perak?

I challenge Datuk Ramly Zahari to give the details with regard to the 60 multi purpose and community halls where electricity and water were cut.

If Datuk Ramly Zahari was referring to 10 months of unpaid bills during the PR reign, what happened to the last 13 months when BN took over? He needs to clarify.

There is no question of unpaid water or electricity bills during the PR Government rule, as LAP is owned by the Perak Government and the State has about RM800 million in reserve. The Pakatan Rakyat brought in additional RM100.4 million into the State coffer in 2008.

I challenged Datuk Ramly to tell the truth and if he has a political agenda against Dato’ Seri Zambry, let it be also make known to the public.

DAP expresses deep disappointment at the Federal Court’s unanimous decision that Datuk Seri Dr Zambry Abdul Kadir is the rightful Menteri Besar of Perak following the defection of 3 Pakatan Rakyat ADUNs towards BN on 4 February 2009.

The Federal Court decision is contrary to the basic democratic principle that a government must be elected by the people. Any government that does not derive any directly elected mandate, not only violates the democratic principle of people’s power but also questions the legitimacy of a people-centric government of the people, by the people and for the people.

Whatever claims BN and Dato Seri Dr Zambry may make over the state government of Perak, there is no denying the fact that both were not democratically elected by the people of Perak in the 2008 general elections. To restore democracy and the constitutional right of the people to determine their government, DAP reiterates our call to BN to dissolve the Perak State Assembly and return power to the people by holding fresh elections.

Formation of Orang Asli Development Advisory Committee by Dato Seri Zambry Bin Abdul Kadir another camonflage to cover up BN’s uncertain legal position as a legitimate government and her inability to perform. The formation of this committee is in fact detrimental to the Orang Asli’s interest as it back track the plans by PR Government to grant the Orang Aslis land titles and to gazette their land as their reserves which were at the implementation stage

Since the grabbing of power from the people elected Pakatan Rakyat Perak State Government on 6/2/2009 the BN Perak State Government led by Dato’ Seri Zambry Bin Abdul Kadir has make numerous announcements with regards to various projects to be carried out in Perak to cover up BN’s uncertain legal position as a legitimate Government and also to divert the people’s attention from her undemocratic and illegal grab of power. I belirve none of the projects have actually taken off. In fact many potential investors were upset that a mere inquiry is announced in the media as the investors going to invest millions if not billions of ringgit in Perak when the lands for the projects have yet to be identified and the EIA reports not done. The people of Perak must realize that unless a democratically elected government is installed in Perak, Perak will continue to suffer. The people of Perak must not be hookwinked by the Dato’ Seri Zambry and his announcements.

The recent announcement by Dato’ Seri Zambry that an Orang Asli Development Advisory Committee will be formed and headed by Datuk Saarani Mohamad is another such example of a camonflage to mislead the people that the BN Perak Government is doing something for the people while in fact acting against the interest of the people. Why do we need another advisory committee? We have already Jabatan Orang Asli, Jaringan Orang Asli and hosts of other orang asli related organizations who are able to give advice. The orang Aslis do not need another advisory committee.

What the orang Asli need is action on the part of the State Government to grant them land and protect their land rights.

Under the Pakatan Rakyat State Government we have already formed a two tier committee headed by me to implement the giving of land titles to orang Aslis and in other cases to gazette their lands as Orang Asli reserve so that they will not be pushed out of their lands whenever a logging company moves in.

If Dato’ Seri Zambry is serious in helping the Orang Aslis he should continue with the implementation of what has been done by Pakatan Rakyat Government rather than back track to form another committee just to mislead the people.

As the legality of the BN Perak State Government is still pending at the Federal Court, the least the BN Government can do is to get the technical details for the granting of lands and the gazetting of the Orang Asli reserves done so that whoever is declared the legal Perak Government can move ahead to grant the Orang Aslis their land titles and also have their reserves gazetted.

DAP Perak takes full responsibility for the 3 frogs door-mat incident at the DAP Perak Annual Convention. DAP leaders who were invited to the convention should not be blamed, UMNO and BN leaders who criticized Lim Kit Siang over the incident has no sense of justice and are hypocrites for failing to criticize their own members who have acted in more terrible manner

DAP Perak takes full responsibility for the 3 frogs (3 Pakatan Rakyat elected representatives who defected) door-mat incident at the DAP Perak Annual Convention and we have apologised to all Malaysians who felt offended by the incident.

DAP leaders including YB Lim Kit Siang, the Chief Minister Penang, YAB Lim Guan Eng and the leaders PKR and PAS who were also invited to the convention are not to be blamed. As the door mat was placed across the entrance to the convention hall, all persons entering the hall will have to step on the door mat.

UMNO leaders have singled out YB Lim Kit Siang for attack. This is totally unjustified and it clearly show their lack of the sense of justice.
The door-mat was not placed by YB Lim Kit Siang and all persons entering the convention hall would have also stepped on the door-mat.

UMNO leaders who criticized the incident are hypocrites as they failed to show the same displeasure when BN/UMNO members did similarly or worse in the following incidences:-

(i) UMNO members stepping on the portrait of Tan Sri Dr Koh Tsu Koon last year.

(ii) BN members burning the portrait of the Chief Minister of Penang, YAB Lim Guan Eng, recently.

(iii) Perak BN Youth tearing the portraits of YB Lim Kit Siang, my portrait and other PR Leaders.

(iv) The storming of APCET II (Asia Pacific Conference on East Timor) meeting by UMNO Youth.

(v) UMNO Youth Chief, Khairy Bin Jamaluddin behaving in an unruly manner during the visit of the Secretary of State of the United States of America, Condoleeza Rice, to Malaysia.

“The Auditor General has confirmed that the Pakatan Rakyat State Government of Perak has caused improvement to each and every department and agency of the Perak State during its 11 month’s rule. The PR Government has succeeded in making historic achievements during this short period. It is without a doubt that PR is the hope of the people and it has brought the changes the people had voted for on 8/3/2008”

1. The Betrayal
The last one year see tumultuous times in Perak with the unlawful and undemocratic grabbing of power by BN on 7/2/2009.We saw one of us, Mdm Hee Yit Fong prostituted herself to BN and two others Mohd Osman Bin Mohd Jailu and Jamaluddin Bin Mohd Radzi from PKR who sold themselves to BN which caused the downfall of PR Government in Perak. They will be scorned upon for posterity. In the very near future when they are us longer useful to BN, BN will treat them worst than lepers of the past and dogs with sores to be avoided for that is the contempt BN has for them. That time is very near and let all comrades be reminded that history has never been kind to those who sold their souls for benefit. To prove my point I challenged Hee, Osman & Jamaluddin to ask BN now to promise them that they will be made candidates for their respective constituencies in the next election and see the BN’s replies to them. However, in order that history will not be too harsh to them, I urge them to repent and declare that they no longer side BN and support giving back the power to the people by calling for by-elections at their respective constituencies or support the dissolution of the Perak State Assembly. T

2.The effect of the illegal & undemocratic grab of power What concern us more, is the effect of this political crisis on our beloved state of Perak and the nation of Malaysia.We see the police who are enforcers of the law have been reduced to taking instructions from the BN government.

The Judiciary which is the baston of the constitution and the rule of law has on many occasions in the words of the retired Court of Appeal Judge, Dato’ N. H. Chan decided against the plain provisions of the law. The Sultan of Perak has refused to dissolved the state Assembly at the request of Menteri Besar, YAB Dato Seri Nizar Bin Jamaluddin against his very stand as stated in his book “Constitutional Monarchy, Rule of Law and Good Governance” where His Royal Highness said:“Under normal circumstance, it is taken for granted that the Yang di Pertuan Agong (the sultan) would not withhold his consent to request for dissolution of Parliament (State Assembly). His role under such a situation is purely formal”

The police invaded the Perak State Assembly and forcibly evicted the speaker, V. Sivakumar on 7th May, 2009 and help BN installed a bogus speaker who was elected by BN elected representatives even before the Assembly Session was opened by His Royal Highness the Regent of Perak.All these spell disaster for the Perak state and nation of Malaysia. It is imperative on all of us, who love Malaysia to save Malaysia by restoring the constitution to its rightful place and to uphold rule of law.The way forward is to take Putrajaya and there is no two ways about it as reform to the police and the judiciary can only be done by taking federal power. Let us pledge to day to save our nation by working towards Putrajaya.

3. How have we performed ?

Do the people have faith in us? Our 11 months of ruling Perak has crushed to pieces the propaganda perpetuated by BN in the last 50 years that the opposition parties are unable to rule. We have proven them wrong and have outperformed BN in every aspect.

The Auditor General has confirmed that the Pakatan Rakyat State Government of Perak has caused improvement to each and every department and agency of the Perak State during its 11 month’s rule. The PR Government has succeeded in making historic achievements during this short period. It is without a doubt that PR is the hope of the people and it has brought the changes the people had voted for on 8/3/2008 In 2008 the Auditor General audited 7 state departments and 6 state agencies in Perak and found all these state departments and agencies have improved under the PR government. The financial management of the State financial office was accredited with a four star Excellence status of 90.33 marks which was unprecedented. We see mark improvement on the State Economic Development Corporation (SEDC) and the Majilis Agama Islam and Adat Melayu Negeri Perak. The SEDC under BN could not come out with audited accounts for 10 years (1997 to 2006). These were all finally finalised and audited under the PR short rule. Even the 2007 accounts were prepared up to date and audited. Imagine the impact on our state if we are given more time to govern. Imagine the impact we can make if we control the Federal Budget of about RM200 billion yearly which is about 300 times more than the Perak State budget of about RM700 million. We have increased State Revenue by more than RM 100 million from RM538,761,178 in 2007 to RM639,425,143 in 2008 despite not having increased any tax whatsoever on the rakyat and despite we having reduced all land conversion premium and quit rent for not profit organizations to RM 1,000 and RM 40-00 respectively. We increased revenue through hard work, open tender system and zero tolerance for corruption.Our other policies like granting freehold titles for planned and new villages, approving lands for schools and places of worship, supporting Chinese Private Schools and private religious schools by granting them 1000 hectares of land each have endeared us to the rakyat. In the pipeline were programmes to ensure home ownership for all especially the Indians who were displaced from the estates by giving them housing lots, selling homes to them at discounted prices. The welfare policies of helping the poor, the needy and the downtrodden have also been well received.

4. To persevere and serve faithful

I call on all PR elected representatives to continue to serve faithfully and not be discouraged.Though we have lost confidence in the judiciary due to the flip-flop decisions of the courts, we however, still trust that good will triumph over evil. If V.Sivakumar succeeds in his case against the Election Commission and the 3 frogs, we will see by elections in Jelapang, Changkat Jering and Behrang. If Dato Seri Nizar bin Jamaluddin succeeds in his case against Dato Zambry bin Abdul Kadir we will see state wide elections to be called.The PR leadership will continue to do what we can especially through legal court cases while members must continue to influence public opinion, to get the people to persevere and to stay with us. I believe so long as the people are with us. Putrajaya will be a dream that is achievable.

Dissolve the Perak State Assembly for a clear mandate from the people
DAP condemns BN’s shameless and dictatorial take over of the Perak State Assembly yesterday which resulted in violent acts against the rightful Perak State Assembly Speaker Sivakumar and PR ADUNs.
The Barisan Nasional illegally appointed Speaker, Datuk R. Ganesan had banned the use of visual recording devices, mobile phones and laptops in the House. This is totally in contrast of what is practised at Parliament where the parliamentarians can now access the Internet via the computers provided by the Dewan. We condemn these double standards as it was reported that Datuk Mohd Khusairi Abdul Talib (Slim-BN) was seen typing at his laptop throughout the proceedings.
All the Pakatan politicians were subjected to undergo metal detection screening and frisking. This is a clear infringement and a threat to the democratic rights of our elected representatives of the people. Pantai Remis assemblyman Nga Kor Ming received the wrath of the police when he resisted the attempts to a bodily search. During the body search, a police officer had grabbed his private parts. The rightful Perak Speaker, Sivakumar was roughed up while the police were tearing off his robe.
To allow the police to conduct proceedings in the Perak State Assembly proves that there is no more democratically elected government in Perak but that it is a police state.
The Perak Budget 2010 speech was delivered by Datuk Zambry in less than 20 minutes. Very little details very given to the sketchy budget and yet, it was tabled and passed with the support of the BN and Independent State Assemblymen.
DAP reiterates its call of an immediate dissolution of the Perak State Assembly and hold fresh elections in Perak to allow the rakyat the right to choose their own government. Only by returning power to the people, then can justice, freedom, truth and democracy be restored in Perak.

Media Statement by Senior Exco Pakatan Rakyat Perak State Government, MP for Beruas YB Dato’ Ngeh Koo Ham at Parliament, on Monday, 19th October 2009:

Najib and Zambry should heed their own advice and follow the law. They have no moral standing to advise others to act correct politically, morally and legally until they themselves do so and dissolve the Perak State Assembly

Prime Minister Datuk Seri Najib Tun Razak has advised MCA leadership not only be legally correct but also morally and politically acceptable when finding a solution to the MCA crisis. He together with Dato’ Seri Zambry Abdul Kadir, the court appointed Menteri Besar of Perak have warned Pakatan Rakyat to obey the law in this coming 28 October 2009 sitting of the Perak State Assembly.

Shame on them! Both Najib and Zambry were the ones who have acted immorally, illegally and their actions were not politically acceptable when they toppled the Pakatan Rakyat Government of Perak in February this year. They denied the people their rights to choose their government and courted the assemblymen who they themselves accused of being corrupt to support them just to gain power in Perak. They did not follow the law and went against the very democratic principles upon which the foundation of this nation is laid.

Perak BN continue to ignore the law by claiming that Dato’ Ganesan is the lawful speaker. He was never elected as one on 7 May 2009 as there was chaos in the Perak State Assembly and Assembly sitting has not begun when he was purported by elected at around 10.30 am. If BN follows the law, they must accept the fact that when the lawful speaker, V. Sivakumar was chairing the Assembly no one else can have the authority to chair another sub-Assembly within the State Assembly. The sitting had not begun until the Regent of Perak delivered his opening speech at 3.06 pm on 7 May 2009. The sitting on 7 May 2009 itself was not valid as the lawful speaker, V. Sivakumar was forcibly evicted and imprisoned in a room by the police just prior to the opening speech of the Regent of Perak.

Dato’ Ganesan has failed to take and sign the oath of office before the State Assembly on 7 May 2009 as required by Article 36A(1A) of the Perak Constitution.

Event if Dato’ Ganesan was lawfully elected on 7 May 2009 (which is denied), Article 36A(5) of the Perak State Constitution has disqualified him as Dato’ Ganesan has failed to resign from this legal profession within the prescribed 3 months’ period.

BN has also instructed the police to breach the law by arresting more than a hundred people who did not commit any offence in the Perak crisis. The fact that none of them have been charged only goes to show that it was the police who committed wrongful arrests against them. The BN Government has also refused to disclose the names of the police officers who invaded the Perak State Assembly and forcibly evicted the lawful, V. Sivakumar when the question as asked in Parliament. Why is BN Government protecting these wrong doers? The police has told me that they were only carrying out the instructions of their BN political masters.
As BN has failed to follows the law, lawlessness will continue in Perak.

The situation in Perak rightly justify the dissolution of the Perak State Assembly as there is a stalemate as to who rightfully should lead the Perak State Government and the Perak State Assembly. The democratic convention demands that the assembly be dissolved in such circumstances.

I call on Datuk Seri Najib and Dato’ Seri Zambry to follow the law and agree to a dissolution of the Perak State Assembly as the people of Perak has suffered enough. ‘People first’ slogan of BN remains a slogan until the Perak State Assembly is dissolved to pave way for a fresh election.

A new member has joined Dato’ Ngeh Koo Ham's existing public service team which serves the Sitiawan State constituency and Beruas Parliamentary constituency. She is Ms Lin Hui (012-5233730) (to the right of Dato’ Ngeh in the picture).

She will be in charge of the Beruas constituency based in Pantai Remis (05-6772797).

Mr Paul Yong, Political secretary (012-5184733) will be the overall coordinator for both constituencies. He will represent Dato’ Ngeh at dinner functions and all press conferences and also attend to all problems faced by the people in both constituencies.

Merdeka Celebration for Perakian?

Media Statement by Ngeh Koo Ham in Ipoh on Tuesday, 1st September 2009:

The people of Perak did not celebrate Malaysia Independence day yesterday (31st August 2009) because they have been colonized again. We must regain our independence and the first step is to boycott the BN colonist.

In Perak though a State within the Federation of Malaysia, there was hardly any celebration of Malaysia Independence Day yesterday (31st August) and the days preceding it. This is understandable as the people of Perak had been colonized again i.e the imposition of the will of a group of people over the will of the general populace. This domination was enforced by force literally through the barrel of the gun. The BN party and the its leaders who have been rejected by the people of Perak used the police to enforce their dominance.

On 3 March 2009, we saw the police preventing Perak State elected representative from entering the State Assembly to attend a meeting convened by the lawful Speaker, YB V. Sivakumar.

On 7 May 2009, we saw the police invading the State Assembly and forcibly removing the lawful Speaker and imprisoning him in a room.

On many other occasions we have also seen police preventing the lawful Speaker and his Privileges Committee members from operating or using the State Assembly facilities.

Police have also been used to arrest hundreds of people who protested against BN for trampling upon the democratic rights of the people of Perak. Many were arrested for wearing black shirts, holding candle light vigils, drinking black coffee and holding protest fasts.

BN the colonial master of Perak is running Perak like a police state.

The BN colonial master tried to create a semblance of Independence Day celebration by putting up flags at government buildings but people of Perak were in fact mourning the death of democracy in Perak.

According to surveys conducted by NTV 7, Merdeka Centre and others, about 90% of the people of Perak (supporters from both BN and PR) wants the State Legislative Assembly dissolved to pave way for a fresh election to resolve the present constitutional crisis. The will of the people must be respected.

I challenged the Prime Minister, Dato’ Seri Najib Tun Razak, as Chairman of BN and Dato’ Seri Zambry Abdul Kadir as BN chief in Perak to dissolve the Perak State Legislative Assembly if they truly subscribe to democratic principles. Otherwise, the people of Perak must continue to strive against this colonial Master until democracy is restored. The 1st step is to boycott the Perak BN State Government by not inviting Dato’ Seri Zambry and his exco members to any of our functions.

Zambry must clarify the position of the 14,000 hec of land approved to Rahman Hydraulic Tin Bhd as announced by Dato’ Hamidah Osman, his Senior Exco in April this year

On 7/8/2009, Dato’ Seri Dr Zambry Abdul Kadir accused me (Ngeh Koo Ham), YB Nga Kor Ming (MP for Taiping and PR Perak State Government Exco member) and YAB Datuk Seri Mohd Nizar Bin Jamaluddin (PR Perak Menteri Besar ) of spreading lies and accusing the BN State Government of approving 14,000 hec of land to Rahman Hydraulic Tin Bhd for Tin prospecting. The same was in fact announced by Dato’ Hamidah Osman, Zambry’s State Government Senior Exco member in April this year to be media. Zambry should clarify whether he is lying or Hamidah Osman is lying and both of them have a duty to the public to clarify the actual situation with regard to the approval of the said 14,000 hec of land.

Since my media statement on 12/8/2009 on this issue, Dato’ Seri Zambry has been exceptionally quiet on this matter. We at Pakatan Rakyat and the people of Perak demand from him transparency and he should clear the air on this issue immediately or we can presume that another scandal is brewing and will cause huge damage to the State of Perak and her people unless it is stopped now.

The Malaysian Bar Council Press Release confirms that Dato’ R. Ganesan was dishonest with regard to the time he ceased practice as a lawyer. Dato’ R. ganesan wrote to Bar Council only after V. Sivakumar’s lawyer notified him that even if he had been duly elected as Speaker (which he was not) he would also have been disqualified
The Malaysian Bar Council Press Release confirms that Dato’ R. Ganesan has been dishonest when he said he ceased legal practice on 6/8/2009. It was obvious that he had fraudulently back dated his letter to the Bar Council.

The Bar Council had issued a letter to V. Sivakumar’s lawyer, Mr Chan Kok Keong informing him that Dato’ R. Ganesan was still in active practice as on 11/8/2009.

On 12/8/2009, Mr Chan Kok Keong served an affidavit containing the said confirmation on Dato’ R. Ganesan’s solicitors.

The Bar Council confirm that it was only on 13/8/2009, that they received a fax from Dato’ R. Ganesan a letter dated 6/8/2009 informing them that he has ceased practice as from 6/8/2009. It was obvious that Dato’ R. Ganesan had back dated his letter.
Only on 17/8/2009 that the Bar Council acknowledged receipt of Dato’ Ganesan’s back dated letter dated 6/8/2009 and his Notice of Cessation and Statutory Declaration dated 17/8/2009.

The spirit of Article XXX VIA (5) of the Perak Constitution is that the Speaker must cease his existing business or profession immediately and in any case not more than 3 months after his appointment as Speaker failing which he shall be disqualified.
While we never at any time recognize Dato’ R. Ganesan as lawfully elected, even if going by BN’s contention that he was lawfully elected (which he was not) he was disqualified as from 7/8/2009. Dato’ R. Ganesan cannot revive his Speaker post after disqualification by back dating his letter.

What is most disappointing is that we see dishonesty everywhere in BN. From Permatang Pasir candidate, Rohaizat Othman to the court appointed Perak Menteri Besar Dato’ Seri Zambry Bin Abdul Kadir and now to Dato’ R. Ganesan, they have been less than honest in their dealings and actions.

Zambry is telling lies again. Perak Pakatan Rakyat Leaders never at any point of time explicitly or implicitly recognize Dato’ R. Ganesan as the Speaker of Perak Legislative Assembly. Zambry’s approval rating is the worst among all Menteri Besars/Chief Ministers. Challenge Dato’ R. Ganesan to swear on oath as to when he actually wrote to the Bar Council to cease his legal practice

Either Dato’ Seri Zambry Bin Abdul Kadir does not understand English or he is a prolific liar. Referring to the joint media statement by the Perak Pakatan Rakyat Leaders (a copy of which is attached) issued on 21/8/2009, Zambry said that PR leaders have acknowledged Dato R. Ganesan as Speaker. I would like to emphasise that every single paragraph in the said media statement refutes the claim by Dato’ R. Ganesan and BN that he is the lawful Speaker.

The first sentence started off with ‘We all know that Dato’ R. Ganesan was never properly elected as the Speaker ………….’. The second paragraph asks ‘How can a proceeding or a decision made prior to the commencement of a meeting the valid?’
The disclosure by the lawyer of Speaker YB V. Sivakumar concerning the confirmation from the Malaysian Bar that Dato’ R. Ganesan was still actively practising as a lawyer at on 11/8/2009 (more than 3 months after his purported election as Speaker by BN representatives) was to emphasise that even Dato’ R. Ganesan does not believe that he was legally elected and had refused to surrender his practising certificate. Also, had he been legally elected (as alleged by BN)(which he was not) he would have been disqualified.

I sincerely believe that only after Dato’ R. Ganesan was served the YB V. Sivakumar’s affidavit stating that even if Dato’ R. Ganesan was rightfully elected (which he was not) he would have been disqualified under Article XXX V1A(5) of the Perak Constitution, that he wrote to the Bar Council to inform them of his intention to cease his legal practice.

I challenged Dato’ R. Ganesan to swear on oath the actual date he sent his letter to the Bar Council otherwise we can believe that he has back dated his letter to the Bar Council.

Recent survey shows that the approval rating for Zambry is only 36%, the worst among all Menteri Besars and Chief Ministers. The MB/CM with highest rating is Tok Guru Nik Aziz of Kelantan followed by Lim Guan Eng the Chief Minister of Penang.
I believe the 36% who approved of Zambry are the hardcore UMNO members while the balance 64% Perakians reject him.

I call on Zambry to quit as the MB of Perak as he is not the people’s choice by calling a fresh election for Perak. At least in this way he can contribute to Perak by starting a precedent in Malaysia which has been well established in other democracies that we gracefully leave office when the people reject us.

Joint Media Statement by Perak Pakatan Rakyat leaders in Ipoh on Friday, 21st August 2009:

Dato’ R. Ganesan is not the Legitimate Speaker of the Perak State Legislative Assembly. Even if he had been legitimately elected, he is now disqualified by virtue of the Perak State Constitution as Dato’ R. Ganesan continues in his profession as an Advocate & Solicitor

We all know that Dato’ R. Ganesan was never properly elected as the Speaker of the Perak State Legislative Assembly at the sitting on 7/5/2009 where the lawful and legitimate Speaker YB V. Sivakumar was illegally and forcibly removed from the State Assembly.

The purported election of Dato’ R. Ganesan by the BN elected representatives holding a sub-assembly within the Assembly was carried out before the opening of the session of the Legislative Assembly i.e before the opening speech of his Royal Highness the Regent of Perak. How can a proceeding or a decision made prior to the commencement of a meeting be valid? Moreover, at the material time the legitimate speaker YB V. Sivakumar was still holding the chair of the Speaker at the State Assembly sitting.
We have been informed by Mr Chan Kok Keong, the lawyer for Speaker YB V. Sivakumar that he has received a letter from the Malaysian Bar dated 12.8.2009 confirming that Dato’ R. Ganesan is still actively practising as a lawyer holding a valid Practising Certificate under the Legal Profession Act 1976. A copy of the letter is annexed hereto.

Even assuming that Dato’ R. Ganesan was rightfully elected (which he was not) on 7/5/2009, his failure to cease practice as a lawyer would have disqualified him in any event by virtue of Article XXX VIA (5) of the Laws of the Constitution of Perak which provides as follows:-

(5) A member who is elected to be the Speaker shall be disqualified from holding such office if after three months of his election to such office or at any time thereafter he is or becomes a member of any board of directors or board of management, or an officer or employee, or engages in the affairs or business, of any organization or body, whether corporate or otherwise, or of any commercial, industrial or other undertaking, whether or not he receives any remuneration, reward, profit or benefit from it:

Provided that such disqualification shall not apply where such organization or body carries out any welfare or voluntary work or objective beneficial to the community or any part thereof, or any other work or objective of a charitable or social nature, and the member does not receive any remuneration, reward, profit or benefit from it.

It has been more that 3 months since the purported election of Dato’ R. Ganesan as the Speaker of the Perak State Legislative Assembly and by continuing in his legal profession, he is now disqualified as its Speaker even if we accept BN’s assertion that he was properly elected.

Therefore, we hope that BN will respect the rule of law and recognize that the only legitimate Speaker for the Perak State Legislative Assembly is YB V. Sivakumar.

Perak State is in a stand still mode and the people suffer as a result. Call on the people to boycott Zambry and his exco for refusing to bow to the wishes of the people that the Perak State Legislative Assembly be dissolved and a fresh election called to resolve the present predicament.

More than 6 months have elapsed since the immoral and unprincipled grab of power in Perak by Dato’ Seri Zambry Bin Abdul Kadir and his Exco members. The people of Perak is suffering as no serious investor would want to have a look at Perak due to the uncertainties created by Dato’ Seri Zambry and his BN power grabbers. Recent announcements that some investors are interested to invest in Perak are only eyewash to mislead the people. None of the projects is moving and investors remain at the interested to invest stage.The position of the Menteri Besar is still in doubt waiting for the final arbiter, the Federal Court to make a decision. Entangled together with the question as to who the legitimate Menteri Besar is, is the uncertainty of the local councilors and the village heads appointed by BN to replace the councilors and village heads appointed or elected under the Pakatan Rakyat Government. We hardly see anything moves in Perak as a result. BN is solely responsible for this state of affairs.

During the 10 months’ reign of Perak by Pakatan Rakyat under the able leadership of Dato Seri Nizar Bin Jamaluddin, people see positive changes sweeping through Perak which benefited them. During the short 10 months, scores of positive changes were made which benefited the people.

The people must end this present predicament and the way forward is to dissolve the State Legislative Assembly and allow a fresh election to be held. 90% of those surveyed (which includes both BN and PR supporters) wanted the State Legislative Assembly dissolved. We cannot allow Dato’ Seri Zambry Bin Abd Kadir to go against the wishes of the people. I call on the people to boycott Zambry and his exco members. All organizations and associations must stop inviting them to their functions to send a clear and strong message that we will not accept Zambry’s refusal to dissolve the State Legislative Assembly. Zambry from UMNO with his racist’s mind has said that I have called on the Chinese Associations not to invite him to their functions which is a lie. He tries again to play the racial card which is in vogue with UMNO leaders. My call is to all organizations and associations and to people of all races and religions to boycott him and his Exco members. The desire to see the Perak State Legislative Assembly dissolved to pave the way for a fresh election comes from people of all races and religions as the people is demanding back their democratic rights to chose their leaders to lead the state of Perak.

The letter supposedly given to lawyer Gobind Singh Deo concerning Teoh Beng Hock's interrogations by the MACC was handed over to the Commission of inquiry yesterday revealed by RPK on his blog, Malaysia Today. There are good souls with consciences and are upright in the MACC who cannot tolerate injustice and corruption within MACC itself, the so called ANTI-CORRUPTION AGENCY (B*llsh***..........) They investigate only PR politicians!!!!!

The onus is on the UMNO/BN government now to investigate without fear or favour as Hishamuddin said. There should not be any cover up. The truth will definitely be revealed.

Those heartless people who said that TBH had ommitted suicide need to apologize to his family members now that the truth has started to surface. Dr. Gigi's days are numbered!

According to the Malaysian Insider today, Journalist Noor Azam of Utusan Malaysia opined in today's paper that the Malays are cowards - they dare not stand up against the Chinese and the Indians.

While our Prime Minister is trying to unite us (sincerely?) and promote 1Malaysia this journalist is trying to divide us, play with fire and cause disharmony. We in the Pakatan Rakyat are doing all we can and have achieved good results in uniting all the races but there are certain quarters trying to destroy the peace we have enjoyed thus far.

This is a threat to our national security but will the Home Ministry invoke ISA on the journalist? I call on all peace-loving Malaysians and Pakatan Rakyat members together with all their supporters to boycott Utusan Malaysia

'Justice For Sdr. Beng Hock' candlelight vigil

A candlelight vigil was held in Sitiawan on the 25th of July 2009 at Dato' Ngeh Koo Ham's service centre. The vigil was organized by the Lumut Liaison Committee.

Dato' Ngeh spoke to the crowd of more than 400 people for about an hour without any interuption from the police. Thanks to the police. There were more than 20 police personnel 'joining' the vigil!

The crowd also donated a total of RM1497 to the education fund set up for Teoh Beng Hock's child by DAP Malaysia.

We want to convey our deepest condolences to the family of Teoh Beng Hock on the tragic death of our comrade. We are saddened by the shocking news of his death and we want a thorough investigation into this. The MACC should be held responsible since his death occurred while he was under custody.

Is this a case of intimidation to scare people who serve with the Pakatan Rakyat government? We should embark on a nationwide campaign to demand a truthful explaination from the BN government. We want fair treatment in all matters by all agencies.

Pas candidate En Mohd Fauzi Abdullah won the Manek Urai state seat by-election by a majority of 65 votes, down from 1652 in the March 8th 2008 general election. BN has lost all by-elections in Peninsular Malaysia after the 12th general election: Permatang Pauh, Kuala Terengganu, Bukit Gantang, Penanti, Bukit Selambau and now Manek Urai.

Police report against the Police.

The Pakatan Rakyat Secretariat led by the Secretary, En. Mohd Yusri bin Yaacob lodged a police report yesterday against the police for not taking any action against Umno Youth (Lumut Division) for showing video clips of the ROWDY Perak State legislative assembly meeting on the 7th of May 2009. They showed the edited version in which UMNO ADUNs were portrayed as well-behaved. The video clips were shown in the Majlis Perbandaran Manjung hall on Friday the 19th of May 2009. (Note the venue chosen; government buildings are being used for partisan puposes. Is this allowed?) In contrast, the police raided the DAP Sitiawan dinner on the 9th of May 2009 when we started to play the same video clips at the SMJK Nan Hwa hall, disrupting a hitherto orderly dinner.

RM200,000 for the Indian NGOs?

The Malaysian Insider reported that Dr Zambry blamed the opposition for picking on BN’s weaknesses instead of its strengths. I believe that the Pakatan Rakyat government could have done much more if not for the unethical and unlawful power grab by the BN in Perak as compared to BN (in 50 years) as one can see for the last few months when PR was in power. PR is well accepted by the people not only in Perak but throughout Malaysia. PR obtained 56% of the votes in Perak during the general election in 2008. They garnered stronger support in the Permatang Pauh, Kuala Terengganu and Bukit Gantang by-elections. PR may not have solved all the problems faced by the people but what the PR government could do was acceptable and people are well pleased.

Dr Zambry also announced an allocation of RM200,000.00 for all the 157 Indian’s NGOs in Perak at the Perak Indian NGOs Consultative Convention in Sungai Siput today. Every NGO will get RM1,273.88 –One thousand two hundred seventy three Ringgit Malaysia and eighty eight cents. These are only crumbs under the table. What is there to shout about?

Is the announcement by Datuk Seri Dr Zambry Abdul Kadir of the RM9.0 billion investment by a South American Multinational Corporation another publicity stunt of the BN State Government?

Dato’ Seri Zambry Bin Abdul Kadir has announced yesterday that a South American Multinational Corporation will be investing RM9.0 billion in Manjung for an iron ore/pellet distribution centre for Asia. He added that it is in the final stages of discussion and an agreement is expected to be signed next week.

I have been given to understand that the company is the Brazilian company, Compania Vale Del Rio.

It must be put on record that the said company was in negotiating with the Pakatan Rakyat Perak State Government before the latter was immorally, illegally and unconstitutionally overthrown by the BN.

I hope the BN State Government will not be continuing its policy of announcing many multi million/billion ringgit projects to paint a good picture of the government but none finally materialized as has happened under Dato’ Seri Tajol Rosli.

The Perak Pakatan Rakyat Government has a policy to announce the implementation of projects only if it has been finalized and ready to take off as we hold firmly to our principle that the people must not be misled. Many have lost money investing in lands surrounding projects announced by BN which did not materialize.

Dato’ Seri Zambry Bin Abdul Kadir must confirm that the following are already in place if not the announcement is just another publicity stunt.

1. The Perak State Government has thought through thoroughly the decision to convert the area presently designated for tourism to industrial use.

2. The state government has gazetted the area for industrial use.

3. The Environment Impact Assessment (EIA) report is ready and the report supports the said project.

4. Is the 1,300 acres of land private or state land? If it is private land has Compania Vale Del Rio concluded the purchase of the land with the owner? If it is state land, has Compania Vale Del Rio applied for the land and it has been approved by all the relevant departments and the state government?

Launch of signature campaign to dissolve Perak state assembly

YB Nga Kor Ming launched a signature campaign in Sitiawan this morning to petition HRH the Sultan of Perak to dissolve the state assembly.

The campaign was kicked off in Ipoh on the 27th of May 2009. To date almost 200,000 signatures have been collected.

In his press conference, YB Nga reiterated the DUN must be dissolved to solve the long-standing crisis in Perak. The people must be given the right to choose the government; the government must be decided through the democratic process and not through a power grab or by the courts.

He also challenged the 3 'BN-friendly' state assemblymen to either deny or admit the allegations made by Raja Petra Kamaruddin and Dr Lee Boon Chye that they received millions of ringgit to be 'friendly' to the BN. They should not remain silent. Let the people know the truth. They should clear their names.

If the allegations are true why did BN pay YB Hee RM25 million and the other two RM3 million each? WHY? Discrimination? Does it have anything to do with the impending coruption cases in the courts?

Today marks exactly four months since the POWER GRAB in Perak.

Feb 3: The good and efficient Perak Pakatan Rakyat government falls after Behrang assemblyman Jamaluddin Mohd Radzi and Changkat Jering assemblyman Mohd Osman quit Pakatan Keadilan Rakyat. They became 'Barisan Nasional friendly' even though in August 2008 many BN leaders had condemned them for being corrupted.

Feb 4: Jelapang assemblywoman Hee Yit Foong who claimed to be a faithful DAP member for 20 over years quit the DAP. She was at the press conference held by Prime Minister Datuk Seri Najib declaring the fall of the PR government.

Feb 18: Perak state Legislative Assembly Speaker V. Sivakumar suspended Zambry for 18 months following recommendations by the assembly’s Committee of Priviledge. He also suspended the six BN 'state excos'.

Mar 3: Speaker V. Sivakumar convened the state assembly under the ‘Democracy Tree' after the policemen and ‘thugs’ prevented Pakatan Rakyat assemblymen from going into the state assembly to hold their meeting.

Mar 10: Speaker V. Sivakumar filed a lawsuit at the KL High Court against the 3 BN friendly assemblymen and the Election Commission.

Apr 16: The Federal Court ruled that V. Sivakumar does not have the power to suspend Dr Zambry and his exco members. Speaker without power?

Apr 20: Dato’ Seri Nizar filed an affidavit at the KL High Court stating that he had sought the consent of Sultan to dissolve the state assembly because of the deadlock in Perak.

May 7: Speaker V. Sivakumar was dragged from his speaker’s chair and out of the Perak State Assembly by over 60 police officers and ‘thug’ who entered the assembly illegally. Police arrested 69 people including MPs and ADUN in Ipoh.

In Kuala Lumpur, the police arrested 14 people for having a candlelight vigil in support of activist Wong Chin Huat who had been arrested for asking people to wear black. Five lawyers who went to the Brickfields police station to provide legal assistance to the arrested people were also arrested.

May 9: Police raided Sitiawan DAP’s dinner and confiscated the audio and video equipment as we were trying to show state assembly events from the 7th of May 2009. The police also arrested the technician on duty.

May 11: The KL High Court ruled that Dato’ Seri Nizar was the rightful and legitimate Mentri Besar.

May 19 : 12 'Death to Democracy' protesters arrested in Petaling Jaya.

Among those arrested were a MP and several state assemblymen

May 20: Dr Mah Hang Soon announced that BN is to distribute 50,000 DVDs sowing events in the Perak state assembly. Will the police arrest him?

May 21: 16 people including MPs and ADUN were arrested in Petaling Jaya for a candlelight vigil in the hope of seeing the light of democracy in Malaysia.

May 23: Police raided DAP headquarters in Petaling Jaya and took away computers and DVDs. It was the FIRST time in the DAP’s history that the police had ever raided the office. When did the DAP ever becomes a threat to security? Is DAP producing some illegal DVDs? Or pornographic movies?

May 26: Dato’ Seri Nizar launched the 72-hour ‘hunger strike’/‘fasting together’ at Wisma DAP Ipoh. 19 people were arrested by the police. Among those arrested were several ADUNs and an MP.

May 30: YB Lim Kit Siang was quizzed by the police for blaming PM Najib for the Perak crisis.

Bullied by the Police?

Bullying! Intimidations! Harassment! Intrusion! (By the 'BN’s' police?)

Today’s launching of the ‘fasting together’ among all the Pakatan Rakyat members of diverse religions at Wisma DAP Ipoh by Y.A.B. MB Dato’ Seri Ir Mohd Nizar Jamaluddin was disrupted and prevented by the police. The purpose of the fasting (and prayer) was to pray for Almighty God, the maker of heaven and earth to intervene and to give wisdom to the leaders to solve the Perak crisis as soon as possible for the good of the nation particularly the state of Perak.

There were a few hundred police personnel surrounding the vicinity of the Wisma DAP. The BN also dragged in the Ipoh City Hall Enforcement personnel to intimidate and harass the supporters at the gathering.

At around 7.30am, the police arrested five workers for assembling a canopy and putting up a giant balloon near Wisma DAP. At around 10.30am, Y.A.B. MB Nizar was prevented from greeting the people and the police personnel on duty.

Since the launch of the fast at Wisma DAP was prohibited by the police, supporters decided to adjourn to the Ipoh High Court nearby to hear the proceedings of the suit by 817 JKKK (Ketua Kampong) in Perak against unjust dismissal by the BN government. Those who started to walk there were arrested by the police.

Among those arrested were Member of Parliament for Ipoh Barat YB M Kulasegeran, DUN Speaker, YB V. Sivakumar, YB Thomas Su, YB Chang Lih Kang, YB Leong Mee Meng, and several supporters. The police also deprived the detainees of their right to legal counsel. Lawyer Mr Augustine Anthony, YB Dato’ Ngeh Koo Ham and YB Sivanesan were not allowed into the police station to meet them.

The questions everyone may ask are these:

1) Why are the police so concerned about a fast when they have much more urgent and important duties? Why are they disrupting Pakatan Rakyat’s peaceful time of fasting which breaks all barriers of races and religious? We are law-abiding citizens. We were not and are not violent. The police should have used their resources to solve problems like snatch thefts, robberies, kidnappings, murders especially the murders of Kugan and the foreign model.

2) What are the steps are the police are taking to solve the Mat Rempit problem which has cost innocent lives?

3) What are the steps taken to rid the police force of its rampant corruption?

4) Why is there a heavy police presence at by-elections as well? Is there any other motive than to intimidate voters and prevent them from coming out to vote? Again this is a waste of resources and the rakhat’s money.

The best and most logical solution to the Perak crisis is to dissolve the Perak State Legislative Assembly. Let the people of Perak choose the Menteri Besar and the government they want rather than leave the matter to the court. Let the Menteri Besar be the people’s Menteri Besar and not the court’s Menteri Besar. Pakatan Rakyat is ready to face fresh elections any time. MB Nizar was gentleman enough to request the Sultan of Perak to dissolve the DUN when he was declared the legitimate Menteri Besar by the High Courts on 11th May 2009 even though 56% of the voters in Perak had voted the Pakatan Rakyat in the general election in 2008. We want the mandate to be returned to the people of Perak. This is a democratic country so let the people decide whom they want to elect - whether a corrupted government or clean and able leaders to manage the state of Perak.

let us join Y.A.B. Dato’ Seri Nizar, Menteri Besar of the people of Perak and Speaker YB V. Sivakumar in fasting and prayer tomorrow that the Power of the Almighty God be manifested and His reign come. You may join them wherever you are. They will be at Wisma DAP Ipoh at 10.00AM on Tuesday 26 May 2009 to begin their prayers.

- The prayer of the upright is pleasing to God.
- Pray for those who persecute us.
- If my people, who are called by my name, will humble themselves and pray and seek my face and turn from their wicked ways, then will I hear from heaven and will forgive their sin and will heal their land (Perak).

In happy moments, praise God.
In difficult moments, seek God.

Can someone please explain?

BN can do this but not Pakatan?

According to The Star yesterday, BN is distributing DVDs of the Perak state assembly sitting on the 7th. They will be distributing the edited and 'doctored' version instead of the original and truthful record of events in the state legislative assembly on the 7th of May 2009. BN should be brave enough to show the truth. Is telling the truth wrong in the the eyes of the law? On the 9th of May, DAP wanted to show a clip of actual DUN events in a school hall and this was objected to by the police. Not only that, the police harassed us, threatened to arrest the organizers and when we started to show the clip, policemen and police officers rushed into the hall to confiscate the video equipment. The police also arrested the technician who was operating the PA system when he tried to prevent the police from grabbing the DVD player.

Shame on you!

Arrested at DAP Dinner Sitiawan

The Seri Manjung Magistrate's Court will soon hear the case of the technician who operated the audio visual system at SMJK Nan Hwa where the DAP dinner was held on the 9th of May 2009. The DAP was not allowed to screen video clips of the proceedings in the Perak State Legislative Assembly on the 7 th of May 2009.

Policemen 'gatecrashed' the dinner and confiscated the DVD player, 2 LCD projectors and 2 screens.

We invite all supporters and friends to come and give moral support to the innocent tehnician who was only doing his job. He is employed by the vendor who supplied the PA systems for the dinner function.

'Formula 1' Court

Most Malaysians if not all are amazed at how fast the appeals court decided on the stay of execution of the Kuala Lumpur High Courts declaration yesterday. The High Courts declared on 11 May 2009 that Dato’ Seri Ir Mohd Nizar was the legitimate Chief Minister of Perak and asked Datuk Dr Zambry and his executive councilors to vacate their offices to allow Dato’ Seri Nizar and his executive councilors to return to their offices to continue on their works. The decision has once again put the faith and confident of Malaysian in the judiciary system.

While Dato’ Seri Nizar and his executive councilors were busy getting started with their day at theState Secretariat, Dato Dr Zambry and his team filed for a stay of execution with the Appeals Courts today (12 May 2009). Barely less than 4 hours the Appeals Courts allowed the stay of execution on the declarations of the High Courts at around 1 PM the same day.

Such speedy and efficient work by a public servant is commendable and should be imitated by all if it was genuine. I doubt so. Why? Why there are so many cases backlogged? Many of these cases had been dragging on for many years.

Whatever UMNO/BN does now cannot redeem the bad, indeed very bad image they have portrayed thus far. The whole nation, not only the people of Perak, are getting angrier, more disgusted, and more disappointed and will hate UMNO/BN for many ‘generations’.

Tun Dr Mahathir and Tengku Razaleigh who are UMNO members have spoken up. NGOs, various associations and guilds as well as religious groups also desire that the State Legislative Assembly be dissolved. Gerakan Central Executive member, Dr Hsu Dar Ren, also agreed that fresh elections are the best solution.

This is the only way to solve the long-standing crisis which is not beneficial to the Barisan National nor to Pakatan Rakyat. Businessmen are facing many uncertainties the investors cannot wait-time is money.

Therefore let us face the democratic process of elections and whoever wins should get down to work immediately to cushion the effects of the global economci slowdown and take immediate steps to overcome the influenza epidemic. Is this not the most noble thing to do? BN - do not be wise in your own eyes!
